Ord 094-94 7/18/1994F • ORDINANCE NO. 41 -(-1 (4 AN ORDINANCE AMENDING CHAPTER 32, ARTICLE VI OF THE CODE OF ORDINANCES PROVIDING FOR WASTEWATER DISCHARGE PERMIT FEES; ESTABLISHING ABNORMAL SEWAGE SURCHARGES; PROVIDING A SAVING CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR AN EFFECTIVE DATE; AND FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . Chapter 32, Article VI , Subsection 16 of the Code of Ordinances shall hereafter read as follows: "SECTION 16. WASTEWATER TREATMENT RATES AND FEES 16. 1 Wastewater Discharge Permit Fees Wastewater discharge permit fees shall be fixed according to the following schedule: Categorical Industries $400.00 Non-Categorical Significant Industries 300.00 Other Industries 200.00 The above rates are for a permit issued for a period of one year. The Control Authority may prorate the above amounts in the case of permits with shorter durations, or may multiply the above amounts by the appropriate factor in the case of multi-year permits. Unless otherwise designated on the permit all permits expire at midnight on September 30 of the designated year. 16.2 Abnormal Sewage Surcharge A. Abnormal sewage shall be defined as sewage containing BOD and/or TSS in concentrations greater than 300 mg/1 and/or FOG in concentrations greater than 100 mg/l . B. Any industrial user whose discharge contains abnormal sewage shall be subject to a monthly sewage surcharge payable to the City Water Utilities Department; said surcharge shall be in addition to monthly sewer service charges. Monthly surcharges shall stay in effect until such time as the industrial user demonstrates that it has reduced the abnormality. The reduction must be attained in accordance with Subsection 4.6 and Section 5 of this ordinance. The surcharge shall be based on data determined via EPA-approved methods. ;See 40 CFR 136 ) This data shall be derived from all sampling done at least in the previous six-month period, but this period may be longer if deemed appropriate by the Control Authority. The Control Authority reserves the right to either increase or decrease the surcharge at any time to reflect additional data from sampling. I 1 t- . . "• C. The surcharge for abnormal BOD shall be $0.075 per 100 cubic feet of water usage for each unit or fraction of 300 mg/1 in excess of 300 mg/l . Any discharge of water or wastewater with a concentration of BOD more than five (5) times the average twenty-four (24) hour concentration of normal operations of the industrial user shall be prohibited without the prior notification and specific permission of the Control Authority. D. The surcharge for abnormal TSS shall be $0.075 per 100 cubic feet of water usage for each unit or fraction of 300 mg/1 in excess of 300 mg/1 . Any discharge of water or wastewater with a concentration of TSS more than five (5) times the average twenty-four (24) hour concentration of normal operations of the industrial user shall be prohibited without the prior notification and specific permission of the Control Authority. E. The surcharge for abnormal FOG shall be $0.075 per 100 cubic feet of water usage for each unit or fraction of 200 mg/1 in excess of 100 mg/1 . Discharge of FOG over 500 mg/1 is prohibited. F. Each surcharge shall be assessed separately. In the case of sewage containing more than one abnormal constituent, the surcharges shall be added together. G. This charge shall be reviewed annually by the Control Authority who may recommend to the City Council adjustments as necessary to reflect true costs to the City. " SECTION 2. Should any section, paragraph, sentence, clause, phrase, or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. SECTION 3 . This ordinance shall take effect immediately from and after passage and publication in accordance with the Charter of the City of Wichita Falls, Texas, and it is accordingly so ordained. SECTION 4 . It is hereby officially found and determined that the meeting at which this amendment was passed was open to the public as required by law.
