I CI) G AN ORDINANCE AMENDING APPENDIX C, SECTION 6600 OF THE ZONING ORDINANCE TO ALLOW CERTAIN OUTDOOR ENTERTAINMENT TEMPORARY USES; ESTABLISHING STANDARDS; ESTABLISHING A PERMIT FEE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, The Planning and Zoning Commission has determined that there is a need to amend the Zoning Ordinance to allow outdoor entertainment uses on a temporary basis; and, WHEREAS, the City Council concurs with the need for a provision to allow such uses in keeping with public interest. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. That Appendix C, Zoning Ordinance, is hereby amended to permit outdoor entertainment uses on a temporary basis subject to the conditions shown in Attachment A. SECTION 2. It is hereby found and determined that the meeting at which this ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the 2nd day of August, 1994. 000009' . I. I. P- MAYO ' ATTEST: CITY CLERK ATTACHMENT A 6600 TEMPORARY USE REGULATIONS E. Outdoor entertainment associated with a nonresidential use under the following conditions: 1. Duration of the outdoor entertainment use shall be no longer than three (3) consecutive days. 2. Not more than four (4) times per year. 3. Hours of operation shall not exceed 12:00 midnight. 4. Outdoor lighting erected or established for the use shall not encroach onto adjacent residential properties. 5. No music or noise associated with the outdoor entertainment is permitted to be audible at a residential property line. A site plan accurately locating the proposed temporary use shall be required. Refer to the Planning Division for a listing of details to be included on the site plan. A permit shall be required for the temporary use, and a fee assessed for the issuance of the permit of twenty-five dollars ($25.00). The Director of Community Development or his designee shall have the responsibility of ensuring that the terms and conditions established herein are enforced. The Director of Community Development or his designee shall refer any temporary use which he refuses to approve to the Planning and Zoning Commission.
