ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 27 OF THE CODE OF
ORDINANCES BY PROVIDING STANDARDS AS TO LOCATION OF
SIDEWALKS WHERE REQUIRED; DECLARING AN EMERGENCY; AND
OFFICIALLY FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDNANCE WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the City Council of the City of Wichita Falls deems it advisable and in the public
interest to set a standard governing the location for construction of new sidewalks within subdivisions.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS:
SECTION 1. Chapter 27-30 is hereby amended
From:
Sidewalks shall be required in all new subdivisions in which new street dedications are proposed
within the plat of the subdivision. Street construction plans submitted by the developer in
accordance with the subdivision regulations of the City of Wichita Falls shall indicate the
desired location of the proposed sidewalks. The Director of Public Works may approve such
sidewalk design if it provides an obstruction-free location, which is not less than four (4) feet in
width. Construction of the sidewalks by the developer or by individual property owners shall be
in accordance with standard specifications of the City of Wichita Falls.
To:
Sidewalks shall be required in all new subdivisions in which new street dedications are proposed
within the plat of the subdivision. The sidewalk shall be obstruction free and not less than four
(4) feet in width. Sidewalks shall be constructed within the street right-of-way with the edge of
the sidewalk one (1) foot from and parallel to the right-of-way. Construction of the sidewalks
by the developer or by individual property owners shall be in accordance with standard
specifications of the City of Wichita Falls. An alternate location within the street right-of-way
may be approved by the Director of Public Works in cases of existing obstructions, unique
subdivision design or where necessary to be compatible with existing sidewalks or under special
conditions when the specified location is technically unfeasible.
SECTION 2. The operation of this Ordinance demands immediate reaction by the City Council of
the City of Wichita Falls, Texas, and the same is imperative to public necessity requiring the suspension
of the Charter requirement that no ordinance shall become effective until the lapse of thirty (30) days
thereafter; the City Council having therefore found an emergency and necessity to exist and having
called for the suspension of such Charter requirement, does hereby declare that it shall become effective
from and after its passage.

SECTION 3. It is hereby officially found and determined that the meeting at which this Ordinance
was passed was open to the public as required by law.
