AN ORDINANCE CLOSING, VACATING AND ABANDONING STREETS,
ALLEYS AND EASEMENTS IN THE ORIGINAL TOWNSITE AND THE
CRITTENDON ADDITION, FOR MPEC SOUTH ADDITION, WICHITA
FALLS, TEXAS, AND RESERVING CERTAIN UTILITY EASEMENTS;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the City Council of the City of Wichita Falls deems it advisable and in the public
interest to close, abandon and vacate the streets, alleys and easements hereafter described.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS:
SECTION 1. All of the following 25 foot wide alleys within Blocks 97, 98, 120, 121, 123, 124,
and 125, Original Townsite, City of Wichita Falls, as recorded in Volume 4, Page 4, Wichita County
Plat Records and the 10 foot wide alleys between Lots 1 through 7 and Lots 8 through 14 and between
Lots 17 through 21 and Lots 24 through 26, Block 242, Crittendon Subdivision as recorded in Volume
2, Page 78, Wichita County Plat Records shall be closed, abandoned and vacated subject to the retention
of a utility easement over the entire width and length of all of the alleys described in this section.
SECTION 2. The 25 foot wide alleys shall be closed, vacated and abandoned in Blocks 94, 95, 99,
100, 101, 118, and 119, Original Townsite, City of Wichita Falls, Wichita County, Texas, as recorded in
Volume 4, Page 4, Wichita County Plat Records. No utility easement shall be retained.
SECTION 3. Second Street shall be closed, abandoned and vacated from the east right-of-way line
of Brook Street to its intersection with the west line of the alleys in Blocks 93 and 102. A utility
easement shall be retained over and across the entire tract described in this section.
SECTION 4. Third Street shall be closed, abandoned and vacated from the east right-of-way line
of Bluff Street to its intersection with the west line of the alleys in Blocks 102 and 117, Original
Townsite. A utility easement shall be retained only from the intersection of the east right-of-way line of
Lamar Street to the alley in Blocks 102 and 117, Original Townsite, and from the east right-of-way line
of Bluff Street to the west right-of-way line of Burnett Street.
SECTION 5. Fourth Street shall be closed, abandoned and vacated from the east right-of-way line
to Burnett Street to the west right-of-way line of Lamar Street. A utility easement shall be retained over
and across the entire tract described in this section.
SECTION 6. Lamar Street shall be closed, abandoned and vacated from its intersection with the
north right-of-way line of Fourth Street to the Wichita River. A utility easement shall be retained for
the full 80.0 foot width of the right-of-way from the north line of Fourth Street to the north line of Lot
3, Block 118, Original Townsite, and for the east 30.0 feet of the right-of-way from the north line of
Lot 3, Block 118, Original Townsite to the Wichita River.
SECTION 7. Travis Street shall be closed, abandoned and vacated from its intersection with the
north right-of-way line of Fifth Street to the Wichita River. A utility easement for the full 80.0 foot
width of right-of-way shall be retained from the north right-of-way line of Fifth Street to the north line
of Lot 9, Block 118, Original Townsite.
SECTION 8. Austin Street shall be closed, abandoned and vacated from its intersection with the
north right-of-way line of Fifth Street to the Wichita River. A utility easement for the full 80.0 foot in
width shall be retained from the north right-of-way line of Fifth Street to the north line of Lot 12, Block
119, Original Townsite.
SECTION 9. Bluff Street shall be closed, abandoned and vacated from its intersection with the
north right-of-way line of Third Street to the Wichita River with a utility easement retained over the
entire width and length described in this section.
SECTION 10. Plum Street shall be closed, abandoned and vacated from its intersection with the
north right-of-way line of Third Street to the south right-of-way line of Second Street. No utility
easement will be retained.
SECTION 11. Where easements have been retained by this ordinance, the City of Wichita Falls
hereby reserves a utility easement for the purpose of laying and maintaining all kind and character of
utility lines, including water, gas, electric, telephone, T.V. cable, power lines, and sanitary and storm
sewers.
SECTION 12. It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
