Min 04/19/2011 223 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building April 19, 2011 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present. Glenn Barham - Mayor Dorothy Roberts-Burns - Mayor Pro Tern Linda Ammons - Councilors Michael Smith - Rick Hatcher - Tim Ingle - Mary Ward - Darron Leiker - City Manager Miles Risley City Attorney Lydia Ozuna - City Clerk Mayor Barham called the meeting to order. Item 2a Pastor Gene Holley, Jr., Life Tabernacle Church, gave the invocation. Item 2b Mayor Barham led in the Pledge of Allegiance. Item 3a Tammy Robertson and Krystal Ross, Junior League of Wichita Falls Co-Chairs for 2010 Falls Fest, presented the City a check in the amount of$16,806.76, proceeds from the 2010 Falls Fest event. Mayor accepted the check on behalf of the City and thanked the Junior League for their continued involvement and support of our community. Item 3b Carla Bolin, Chamber of Commerce, with the assistance of Cynthia Delaney, Lindsey Greer, and Kevin Hugman, presented samples of the new official Wichita Falls T-Shirts, which will be on sale at numerous events and locations in our City. This is a fundraiser for Pride in the Falls. Item 3c Paul Fleming with Edgin, Parkman, Fleming & Fleming, P.C., presented the Comprehensive Annual Financial Report. 224 Mayor recognized the high school home school students that were in attendance. He mentioned that they had attended the Council Strategic Planning Meeting and the District 3 Town Hall meeting. Item 4 Caleb Stade, 2013 RM 1154, Holliday, TX, referred to the Wichita River clearing project and asked why Lucy Park was selected as the test project instead of further down the River. Public Works Director Russell Schreiber replied that this area will have a De Minimis affect; the City owns it so no private property to deal with; it is an area representative sample of what will have to be cleared up and down the channel; and we can better determine an estimate for the project. Joel Pelsue, 4858 Tortuga Trail, referred to the student/teacher ratio and the recent budget cuts, and he wanted to know how they are going to get much work done with sixty students to one teacher. Mayor responded that his question needs to be directed to Dr. George Kazanas, WFISD Superintendent, for a more enlightened answer. They will be impacted but they will deal with it and find solutions to the situation. Item 5 Minutes of the April 5, 2011 Council meeting were approved as distributed. Items 6 City Manager gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Ammons that the Consent Agenda be approved. Motion seconded by Councilor Ingle and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None Item 6 Minutes of the Traffic Safety Commission for March 2, 2011 were received. Items 7a ORDINANCE NO. 19-2011 Ordinance Appropriating $5,997 To The Special Revenue Fund For Traffic Enforcement, Received From The Texas Department Of Transportation Selective Traffic Enforcement Program (Click It Or Ticket) Wave Grant FY 2011, And Authorizing The City Manager To Execute All Documents Necessary To Accept Said Grant Funds Moved by Councilor Ammons that Ordinance No 19-2011 be passed. Motion seconded by Councilor Ward and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None 225 Item 7b ORDINANCE NO. 20-2011 Ordinance Suspending The Application Of The Dangerous Building Order Of Ordinance No. 56-2010 To 1034 Harlan To Grant Additional Time For Its Restoration Moved by Councilor Roberts-Burns that Ordinance No. 20-2011 be passed. Motion seconded by Councilor Ward. Edwin Menchaca, 700 Lobban, stated that he plans to repair this structure and requested additional time. Mr. Bobby Teague informed that staff recommends that he be allowed extra time to make repairs. Moved by Councilor Ammons to amend Ordinance 20-2011 by striking the phrase "from this day" after the 90 days, three times after the first time this phrase is used. Motion seconded by Councilor Smith and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Bums, Hatcher, Ingle, and Ward Nays: None Main motion as amended carried by the following vote. Motion seconded by Councilor Hatcher. Edwin Menchaca, 700 Lobban, stated that his mother owns this property and would like to repair it to live in; he requested additional time. Motion seconded by Councilor Smith and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, amd Ward Nays: None Item 8b RESOLUTION NO. 36-2011 Resolution Approving The Rental Of The Mobile Stage At A Reduced Rate To The Komen Wichita Falls Race For The Cure For Use During Its Event On October 8, 2011 At The MPEC Moved by Councilor Roberts-Burns that Resolution No. 36-2011 be passed. Motion seconded by Councilor Ward. Moved by Councilor Hatcher to amend Resolution No. 36-2011 by inserting a rental fee of$400 in the blank. Motion seconded by Councilor Ammons and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None Main motion as amended carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None Item 9a City Clerk provided detailed information - dates, locations, times—for the May 14, 2011 General Municipal Election. Mrs. Ozuna also provided this information in Spanish. Item 9b Council members brought up the following matters. Councilor Dorothy Roberts-Burns: a) Thanked the Fire Department and all volunteers who worked so hard putting out the fires on the north side. Councilor Mary Ward: a) Thanked the Fire and Police Departments for their efforts in fighting the fires. This has been quite an ordeal. Numerous houses were burned to the ground and some are standing but have smoke damage; it is a miracle that there is not much more damage with all the fires we have had. Mark Masman's house was burned to the ground; he is the Director of Christmas in April. It is a tragedy for those who lost everything. 227 Item 9b continued b) Read a letter from Mrs. Dorothy Owens, Charles Owens widow, whose house was flooded in the last flood. Mrs. Owens thanked the City for working so well with them and for all the help in getting her new home finished. Councilor Michael Smith: a) Thanked all the emergency personnel, Fire, Police, and Volunteer Fire Departments for their work on the fires. Volunteer Fire Departments from Friberg, West, East, three from Oklahoma: Hastings, Waurika, Ryan, and from Bowie; we want to thank them all, as well as all firefighters who were called in to work these fires. Fire Chief Foster reported on the number of calls, noting that this was a "fire storm". He commented that it was not over yet and urged everyone to be careful and use common sense. He commended the Police Department for doing an excellent job. He also expressed appreciation to Jeff Badder, Central Services, and Barry Levy, Public Communications, for doing a find job. He thanked the community and the businesses for their assistance; everyone who brought them water and food. Chief Foster thanked his people; they did a fantastic job. He also expressed appreciation to the Sheppard Fire Department for everything they did. c) Expressed appreciation to the volunteers from Sheppard and everyone who helped in this. d) Referred to the 20/20 Plan for Wichita Falls, stating that downtown needed additional lighting in certain areas. Is there a plan to analyze lighting downtown as part of the 20/20 Plan and would like to see if LEDs would help with additional lighting? LED lighting works. Staff will check into that. Councilor Rick Hatcher: a) Quadruple dittos on all the appreciation to Fire and Police Departments, volunteers, and everyone who has been mentioned this morning. Prayers to all those affected. Red Cross and other groups will accept donations to help in this situation. b)Austin wants to help us with a grant because they get $82 out of every ticket that is issued on seat belt infractions; it is a money maker for Austin. c) League of Women Voters' Candidate Forum April 25 in Council Chambers at 7 p.m. d) Mentioned that 40-10% of corn grown in U.S. is being used for alternative fuel, and is driving cost of corn up. We are going to have to come up $850,000 for fuel in next year's budget. He thanked City Manager for finding dollars and making things work; he hopes we can do that without further burdening the tax payers with a tax increase because we are 17.2% above what the average tax is for comparable cities. He thanked City Manager for making budgetary issues work out. He also expressed appreciation to Mr. Jim Dockery for what he is able to do. Councilor Timothy Ingle: a) Welcomed the home school students and thanked them for being here and participating in the public comments. b) Someone asked him why we were paying for the fish in Plum Lake. That is funded by Texas State Parks &Wildlife; City is not involved in advertising Plum Lake. Mr. Jack Murphy informed that the City budgets $5000 to stock Plum Lake but not for advertising. c) Natural disasters need a great deal of coordination, it is so important, and everything was well coordinated during the fires. Proud of you for pulling that together by having the equipment, water, manpower and everything that was needed. Everyone is going to be very impressed on how well all this was handled; it worked well when the time came. Councilor Linda Ammons: a) Thanks to all the firefighters; they did a great job. She mentioned the strong winds we have had and commented that it was a miracle the firefighters could fight the fires in that wind. b) Easter is coming up and hope everyone goes to church and spends time together. Mayor Glenn Barham: a) A big thank you to Fire Chief Foster and Police Chief Bachman, who are much appreciated; thanks a lot. c) Received a phone call from a citizen using the transfer station where he lost his wedding ring; citizen called the transfer station and they looked through the brush and found the ring. The citizen, Mr. Dorzab, thanked the employees especially Roberto, who was very helpful. Mayor reiterated that we have the best employees in the world and this is a good example, as well as the Fire and Police Chiefs'work. Mayor also thanked Sheppard Air Force Base for all their help. 228 Item 9b continued Councilor Ward commented that Mike Masmas had two dogs and they recovered one, but are asking if anyone sees a black lab to call the Ward's home; that is where the Masmas are currently staying. Item 10a-10b City Council went into Executive Session at 10:05 a.m. in accordance with Texas Government Code Sections 551.072 and 551.074. City Council reconvened at 10:58 a.m. Mayor announced that no votes or polls were taken during Executive Session. Item 11 Moved by Councilor Hatcher that Glenn Barham be reappointed to Place 1 of the Wichita Wilbarger 911 Board, with term to expire May 5, 2013. Motion seconded by Councilor Smith and carried by the following vote.
