Resolution Authorizing the City Manager To Execute All Documents
Necessary To Purchase Phase II Of The Central Services Complex
Roofing Project To Lydick-Hooks Roofing Company Through The
TIPS/TAPS Cooperative Purchasing Program, In The Amount Of
Approximately $172,227.00
WHEREAS, on March 19, 2013, the City Council passed a resolution approving
the participation in the Region VIII Education Service Center Texas Interlocal
Purchasing System (TIPS/TAPS) cooperative purchasing contract;
WHEREAS, Lydick-Hooks Roofing Company provided a unit price bid to Region
VIII Education Service Center Texas Interlocal Purchasing System (TIPS/TAPS);
WHEREAS, the City Council finds that this purchase is exempt from competitive
bidding requirements pursuant to Texas Local Gov’t Code § 271.102(c), which provides:
c) A local government that purchases goods or services under this subchapter satisfies any
state law requiring the local government to seek competitive bids for the purchase of the
goods or services.
WHEREAS, the City Council finds that this purchase is exempt from competitive bidding
requirements pursuant to Texas Gov’t Code § 791.025(a)-(c), which provide as follows:
a) A local government, including a council of governments, may agree with
another local government or with the state or a state agency, including the
comptroller, to purchase goods and services.
b) A local government, including a council of governments, may agree with
another local government, including a nonprofit corporation that is created and
operated to provide one or more governmental functions and services, or with
the state or a state agency, including the comptroller, to purchase goods and any
services reasonably required for the installation, operation, or maintenance of the
goods. This subsection does not apply to services provided by firefighters, police
officers, or emergency medical personnel.
c) A local government that purchases goods and services under this section
satisfies the requirement of the local government to seek competitive bids for the
purchase of the goods and services.
WHEREAS, the City Council finds that Lydick-Hooks Roofing Company offers the
best value on the Central Services Complex roofing project through the Region VIII
Education Service Center Texas Interlocal Purchasing System (TIPS/TAPS)
Cooperative Purchasing Program, and it is in the City’s best interest to purchase
services in accordance with the Cooperative Purchasing Programs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The City Manager is authorized to execute all documents necessary to execute a
contract to Lydick-Hooks Roofing Company, through the TIPS/TAPS Cooperative
Purchasing Program, in the amount of approximately $172,227.00 in accordance with
the unit price bids made by said Company to TIPS/TAPS, as shown in the attached
Quote.
