Min 12/03/2013 CITY COUNCIL MINUTES PAGE 1 OF 8 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building December 3, 2013 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Glenn Barham - Mayor Tim Ingle - Councilors Ben Hoover Annetta Dotson - Brian Hooker - Michael Smith - Mary Ward - Darron Leiker - City Manager Miles Risley - City Attorney Tracy Norr - City Clerk - - - - - - - - Mayor Barham called the meeting to order. - - - - - - - - Item 2a - Invocation Pastor Mike Rucker, Bible Baptist Church, gave the invocation. - - - - - - - - Item 2b - Pledge of Allegiance Mayor Barham led in the Pledge of Allegiance. - - - - - - - - Item 3a – Presentation – Employee of the Month – Dede Williams Mayor Barham recognized Dede Williams, Castaway Cover Waterpark, as Employee of the Month for December 2013. He presented a plaque, a letter of appreciation, restaurant tickets, and a check to Ms. Williams and thanked her for her service. - - - - - - - - CITY COUNCIL MINUTES PAGE 2 OF 8 Item 4 - Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. Kathy Probst, 5214 Whispering Creek Lane, said she lives on five acres and while renewing her permit that peafowl are not allowed in city limits. She reviewed the different between peacocks (males) and peahens (females). She said peacocks get loud and aggressive but her peahen is quite. She was not aware that the ordinance prohibits peafowl and no one could tell her why peahens could not be allowed. She asked that the ordinance be reconsidered to allow peahens and possibly peacocks on larger acreage. - - - - - - - - Item 5 - Approval of Minutes of the November 19, 2013 Regular Meeting of the Mayor and City Council Minutes of the November 19, 2013 City Council Meeting were approved as distributed. - - - - - - - - Item 6a – 6d – Consent Items City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Smith that the Consent Agenda be approved. Motion seconded by Councilor Ward and carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Ward, Smith, and Ingle. Nays: None Item 6a- 6d Minutes of the following boards and commissions were received. a) Animal Shelter Advisory Committee, August 9, 2013 (b) Planning and Zoning Commission, October 9, 2013 (c) Wichita Falls Economic Development Corporation, October 15, 2013 (d) Wichita Falls Economic Development Corporation, November 15, 2013 - - - - - - - - Item 7– Council Bill #200 ORDINANCE NO. 66-2013 Ordinance Waiving Section 1(2)(d) Of Resolution No. 112-89, Which Prohibits Water Service Outside The City Limits For Lot 1, Block 1 Of The Dickey Addition, Located At 2211 State Highway 79 South, Which Is Owned By Eddy G. Dickey dba Dickey Oil Field Services Moved by Councilor Hoover that Ordinance No. 66-2013 be passed. Motion seconded by Councilor Ingle. CITY COUNCIL MINUTES PAGE 3 OF 8 Martin Litteken, the applicant’s engineer, said the Dickey’s have been hauling water from Reilly Road since they have owned the property to provide water for their restroom and office use. All steps to acquire the water have been followed. Dickey’s will pay the cost for the tap to the water line. Eddy Dickey, 4703 Redville Drive, said he has been in business for 31 years. He said they will not use more water than they have been hauling. The motion carried by the following vote: Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Ward, Smith, and Ingle. Nays: None - - - - - - - - Item 8a – Council Bill #201 RESOLUTION NO. 133-2013 Resolution Confirming Appointments To The Firefighters’ And Police Officers’ Civil Service Commission Moved by Councilor Ingle that Resolution No. 133-2013 be passed. Motion seconded by Councilor Dotson and carried by the following vote. Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Ward, Smith, and Ingle. Nays: None - - - - - - - - Item 8b – Council Bill #202 RESOLUTION NO. 134-2013 Resolution Authorizing The Purchase Of Eleven 2014 Police Interceptor Utility Vehicles From Wichita Falls Ford, A Local Vendor, In The Amount Of $309,176.01 Moved by Councilor Ingle that Resolution No. 134-2013 be passed. Motion seconded by Councilor Smith and carried by the following vote. Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Ward, Smith and Ingle. Nays: None - - - - - - - - CITY COUNCIL MINUTES PAGE 4 OF 8 Item 8c – Council Bill #203 RESOLUTION NO. 135- 2013 Resolution Appointing Two Members To Serve On The Wichita Appraisal District Board Of Directors Moved by Councilor Smith that Resolution No. 135-2013 be passed with the appointment of Dorothy Roberts-Burns and David Ramsey. Motion seconded by Councilor Dotson and carried by the following vote. Ayes: Mayor Barham, Councilors Hoover, Dotson, Hooker, Ward, Smith, and Ingle. Nays: None - - - - - - - - Item 9a – Staff Council Discussion Jack Murphy gave an update on the TxDOT ROW mowing program. He described the program and showed before and after photos. - - - - - - - - Item 9b – Discussion of Items of Concern to Members of the City Council Members of the City Council presented the following matters: Councilor Dotson asked Mr. Burrus to give an update on cab service provided by Greyhound. Councilor Ingle asked about flood control foliage removal. Russell Schreiber said the city continues to work with private property owners, and city employees are clearing city-owned property. Councilor Ingle also asked about a coyote problem. Lou Kreidler said the city always has coyotes in town, particularly with the lack of water. Snares are being used. Councilor Ingle congratulated the downtown business for the light parade. Councilor Smith added his thanks for the sponsors of the city lights Christmas parade. He noted that the new LED light system makes downtown much brighter. He said the new Parks and Recreation facility off Seymour highway is a great facility. - - - - - - - Item 10 – Executive Session City Council went into Executive Session at 9:27 a.m. in accordance with Texas Government Code §551.071, §551.072, and §551.074.
