AN ORDINANCE WAIVING REQUIREMENTS UNDER RESOLUTION NO.
112 -89, SECTION 1 (2) (D) IN ORDER TO PROVIDE WATER SERVICE
OUTSIDE THE CITY LIMITS TO A USE OTHER THAN A NORMAL
RESIDENTIAL USE LOCATED AT LOT 1 OF THE J. F. GRAY ADDITION
OFF STATE HIGHWAY NO. 79; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, it is the intent of subject resolution of the City Council of Wichita Falls that water sales
outside the City limits should foster proper development in the extraterritorial jurisdiction; and
WHEREAS, the use located at the subject location proposes to operate other than as a normal
residential use; and
WHEREAS, the granting of a waiver with respect to Resolution No. 112 -89, Section 1 (2) (d),
which requires that treated water for uses located in the extraterritorial jurisdiction be used only for
normal residential purposes, would not be contrary to the intent of the stated objective when applied to
Lot 1 of the J. F. Gray Addition due to the nature and usage requirements of the subject use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Said waiver of the provisions in Resolution 112 -89, Section 1 (2) (d) regarding the
property described as Lot 1 of the J. F. Gray Addition is hereby granted in the case of this property. This
waiver shall apply only for a church to be located on Lot 1 and shall not apply to any other uses on this
lot.
SECTION 2. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
