An ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, CLOSING, VACATING AND
ABANDONING A PORTION OF A UTILITY EASEMENT ADJACENT
TO BLOCK 3, HARRISON ADDITION; AUTHORIZING THE
CONVEYANCE OF THE ABANDONED EASEMENT TO THE FEE
OWNER; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE WAS DISCUSSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls has received a request from
Biggs and Mathews, Inc. to close, vacate and abandon a portion of a
utility easement retained under Ordinance No. 1630 when Morrow Street
was closed from Ardath to Van Buren; and,
WHEREAS, the City has determined that it is in the public interest
to close, vacate and abandon this portion of the easement; and,
WHEREAS, the City of Wichita Falls has caused the portion of the
easement to be hereunder closed, vacated and abandoned to be appraised
for its fair market value.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS:
SECTION 1. In consideration of the receipt of Eighty -seven and
no /100 ($87.00) Dollars and other valuable consideration, that portion
of the utility easement retained by Ordinance No. 1630, which was
adjacent to Lot 2, Block 3, Harrison Addition and being more
specifically described by metes and bounds as follows:
A 1,083 square foot tract, more or less, adjoining Lot 2, Block 3,
Harrison Addition
is hereby closed, vacated and abandoned.
SECTION 2. That in consideration of the receipt of Eighty -seven
and no /100 ($87.00) Dollars, the Mayor is hereby authorized to execute
a quit claim deed to James Fontenot and wife, Lynnda Fontenot, for that
portion of the easement described in Section 1.
SECTION 3. It is hereby officially found and determined that the
meeting at which this Ordinance was passed was open to the public as
required by law.

THAT the City of Wichita Falls, Texas, a municipal corporation,
hereinafter called Grantor, acting by and through its duly authorized
Mayor, for and in consideration of the sum of Eighty -seven and No /100
($87.00) Dollars and other good and valuable consideration, in hand
paid by James Fontenot, and wife, Lynnda Fontenot, hereinafter called
Grantees, the receipt of which is herein acknowledged, has granted,
sold, conveyed, released, and forever quit claims unto the said
Grantees, all its right, title, and interest in and to the following
described real property situated in Wichita County, Texas, to -wit:
That certain blanket utility easement retained in a tract of land out
of a part of Morrow Street adjoining Block 3, Harrison Addition, an
addition to the City of Wichita Falls, Wichita- County, Texas, which
street was closed and abandoned by City Ordinance No. 1630, dated
January 26, 1953, said tract being more specifically described by metes
and bounds as follows:
Beginning at a point in the centerline of Morrow Street, said point
bears North 93.77 feet and West 150 feet of the Southeast corner of
Block 3, Harrison Addition, and said point being the Northwest corner
and PLACE OF BEGINNING of this description;
THENCE along said centerline of Morrow Street, N 67 051101" E a distance
of 80.98 feet to a point in said centerline for the Northeast corner of
this description;
THENCE South 21.6 feet to a point in the South right -of -way line of
Morrow Street, for the Southeast corner of this tract;
THENCE along the South right -of -way line of Morrow Street S 67 051101" W
a distance of 80.98 feet to a point for the Southwest corner of this
tract;
THENCE North 21.6 feet to a point in the Morrow Street centerline and
the PLACE OF BEGINNING.
Save and except, the City of Wichita Falls hereby reserves a 15 -foot
wide utility easement along the centerline of Morrow Street, that
portion lying within the above described tract is described as being a
strip 6.6 feet wide, lying south of and parallel to the centerline of
Morrow Street. Said easement being for the purposes of laying and
maintaining all manner and character of utility lines including water,
gas, electric, telephone, television cable, power lines and sanitary
and storm sewers.
TO HAVE AND TO HOLD the above described premises, together with
all and singular the appurtenances thereto, in any way belonging unto
the said Grantees, their heirs, successors and assigns.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a municipal
corporation of Wichita County, Texas, has caused this instrument to be
executed by its Mayor this the 15th day of August, 1995.
