AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING CHAPTER 12, COURT (MUNICIPAL) OF
RECORD, OF THE WICHITA FALLS CODE OF ORDINANCES BY
ADDING A NEW SECTION; PROVIDING FOR THE COLLECTION OF A
SECURITY FEE; REPEALING ALL ORDINANCES AND PROVISIONS
IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND
SAVING CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR
AN EFFECTIVE DATE; AND FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS DISCUSSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council of the City of Wichita Falls finds
that there is a need to provide security in the Wichita Falls
Municipal Court of Record; and,
WHEREAS, the City Council finds further that this ordinance
will help provide better security for citizens who use Municipal
Court and /or employees of the Municipal Court in allowing the
purchase and means to secure and /or improve security measures;
and,
WHEREAS, the City Council recognizes that these funds
collected will be used solely for the purpose to provide security
for the Wichita Falls Municipal Court of Record.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Chapter 12, "Court (Municipal) of Record," of
the Code of Ordinances of the City of Wichita Falls, is amended
by the addition of Section 12 -5.
SECTION 2. Chapter 12 is hereby amended by the addition of
Section 12 -5, which new section shall be and read as follows:
"Section 12 -5. Municipal Court Building Security Fund;
Collection of Security Fee.
In addition to collection of all fees and court costs
authorized by state law, and as ordained in Section 12 -2 of the
Code of Ordinances of the City of Wichita Falls, the Municipal
Court shall assess and collect a Three ($3.00) Dollar security
fee from each person convicted in a trial for a misdemeanor
offense in the Municipal Court of Record of Wichita Falls. All
fees collected under this section shall be paid to the Director
of Finance to be held on deposit by said person in a fund to be
known as the Municipal Court Building Security Fund. All funds
held may be dispensed, as needed, by the Director of Finance to
provide security services for buildings housing the Municipal
Court of Record for the City of Wichita Falls.
SECTION 3. Should any section, paragraph, sentence, clause,
phrase or word of this ordinance be declared unconstitutional or
invalid for any purpose, the remainder of this ordinance shall
not be affected thereby.
SECTION 4. This ordinance shall take effect immediately
from and after its publication in accordance with the provisions
of the Charter of the City of Wichita Falls, and it is
accordingly so ordained.
SECTION 5. It is officially found and determined that the
meeting at which this ordinance was passed was open to the public
as required by law.
