ORDINANCE WAIVING APPENDIX A, SUBDIVISION
SECTION 9 (B) (2) (a) OF THE CODE OF
ORDINANCES WITH RESPECT TO PLACING CURB AND
GUTTER ON THE NORTH SIDE OF SEYMOUR HIGHWAY,
ADJACENT TO THE SOUTH LINE OF LOTS 5 -A & 5 -B,
BLOCK 1, GAGE ADDITION
WHEREAS, it is the intent of the subject section of the Code
of Ordinances of the City of Wichita Falls, Texas to provide for
the proper and orderly development of land inside the city limits
and extraterritorial jurisdiction; and
WHEREAS, the granting of a waiver with respect to Appendix A
Section 9 (B) (2) (a) , which requires the construction of curb
and gutter on all interior streets and on the subdivision side of
all streets fronting part of the boundary of the subdivision,
would not be contrary to the stated objective when applied to the
north side of Seymour Highway, adjacent to the south line of Lots
5 -A & 5 -B, Block 1, Gage Addition.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
Said requirements for curb and gutter along the north side
of Seymour Highway, adjacent to the south line of Lots 5 -A & 5 -B,
Block 1, Gage Addition is hereby waived in the case of this
property.
