AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, DESIGNATING CERTAIN AREAS WITHIN THE CENTRAL
BUSINESS DISTRICT AS AN "ENHANCEMENT DISTRICT "; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council wishes to eliminate slum and blight, to promote economic development of
the downtown area, and to improve the tax base; and
WHEREAS, to facilitate such improvement, the Council wishes to designate an area as an "Enhancement
District ":
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. The term "blighted" will refer to land parcels and/or structures located within this
area as characterized by vacancy or abandonment; and,
The term "blighted" will refer to land parcels and/or structures located within this
area as characterized by lack of maintenance and including structures that fail to meet building code
standards established by the City of Wichita Falls; and,
The term "blighted" will refer to land parcels and/or structures located within this
area as characterized by structural deterioration. At least one quarter of all the buildings in the Facade
Enhancement District are in a state of deterioration; and,
The term "blighted" will refer to infrastructure located within this area as
characterized by deterioration including sidewalks, curb, gutter, streets, and utilities; and,
The term "blighted" will refer to land parcels and/or structures located within this
area as characterized by vacant land with debris, litter, trash, and junk accumulation; and,
The term "blighted" will refer to land parcels and/or structures located within this
area as characterized by lack of sanitary facilities, whereby private, on -site sanitary facilities are lacking
and/or inadequate according to City of Wichita Falls building code; and,
The term "blighted" will refer to land parcels and/or structures located within this
area as characterized by adverse environmental nuisances, such as noise, heavy traffic, and odors, and
whereby the land parcels and/or structures are adversely impacted by traffic conditions caused by
defective or inadequate streets, street layout, or accessibility; and,
The term "blighted" will refer to land parcels and/or structures located within this
area as either adversely affecting the public health, safety, morals, or welfare of the municipality and its
residents, substantially retards the provision of a sound and healthful housing environment, or results in
an economic or social liability to the municipality.
SECTION 2. At least one quarter of the land parcels and/or structures located in the area defined
herein exhibit the above stated conditions. Therefore, the following description defined herein is a
"blighted" area to be designated as an Enhancement District:
Beginning at a point of intersection of westerly Right -of -Way (ROW) line of Indiana Street and the
northerly ROW line of Fifth Street. Said point also being the most southeasterly corner of Lot 12,
Block 127, Original Townsite;
Thence in a northeasterly direction along the northerly ROW line of Fifth Street to a point in the easterly
ROW line of Ohio Avenue;
Thence in a southeasterly direction along the easterly ROW of Ohio Avenue. to a point in the northerly
ROW line of Sixth Street;
Thence in a northeasterly direction along the northerly ROW line of Sixth Street to a point in the westerly
ROW line of the Burlington Northern Railroad;
Thence in a southeasterly direction along the westerly ROW line of the Burlington Northern Railroad
ROW and also along the westerly lines of Blocks 162, 177, and 181, Original Townsites, to a
point in the southerly ROW line of Tenth Street;
Thence in a southwesterly direction along the southerly ROW line of Tenth Street to a point in the
easterly ROW line of the alley within Block 194, Original Townsite. Said alley ROW also lying
between Scott Avenue and Indiana Avenue, and between Tenth Street and Eleventh Street;
Thence in a northwesterly direction along the easterly alley ROW line, passing the easterly lines of
Blocks 183 and 175, Original Townsites, to the most northwesterly corner of Lot 4, Block 175,
Original Townsite;
Thence in a northeasterly direction along the northerly lot line of Lot 4, Block 175, Original Townsite, to
a point in the westerly ROW line of Indiana Avenue. Said point also being the most northeasterly
corner of Lot 4, Block 175, Original Townsite;
Thence in a northwesterly direction along the westerly ROW line of Indiana Street, passing the easterly
lines of Blocks 175, 164, 151, and 140, Original Townsites, to a point in the northerly ROW line
of Fifth Street. Said point also being the place of beginning.
SECTION 3. It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
