An ORDINANCE CLOSING, VACATING, AND ABANDONING A
PORTION OF THE ALLEY AND A UTILITY EASEMENT IN
BLOCK 262, THOMPSON SUBDIVISION; AUTHORIZING THE
CONVEYANCE OF THE PROPERTY TO THE FEE OWNER;
FINDING AND DETERMINING THAT THE MEETING AT WHICH
THIS ORDINANCE WAS DISCUSSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls has received a request to
close, vacate, and abandon a portion of the alley and a utility
easement in Block 262, Thompson Subdivision to allow for the expansion
of the Bethania Hospital; and
WHEREAS, the City has determined that it is in the public interest
to close the hereinafter described tracts.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1.
Tract I
A tract of land being a portion of that 25 foot wide alley
originally dedicated in Block 262, Thompson Subdivision, an addition to
the City of Wichita Falls, Texas, pursuant to that plat of record in
Volume 4, Page 30, Wichita County Plat Records, said tract being more
specifically described by metes and bounds as follows:
Commencing at a 1/2 inch iron rod lying in the intersection of the
West right -of -way line of Grace Street, a previously dedicated street,
and the North right -of -way line of Eleventh Street, a previously
dedicated street, said 1/2 inch iron rod also being the Southeast
corner of said Block 262;
Thence along the West right -of -way line of Grace Street North'
330 49' 35" West a distance of 161.94 feet to a 1/2 inch iron rod being
the Southeast corner of said 25 foot wide alley originally dedicated in
Block 262 and being the Southeast corner and Place of Beginning of this
description;
Thence along the South line of said 25 foot wide alley, South
560 01' 33" West a distance of 577.36 feet to an "X" in concrete being
the Northwest corner of Lot 27, said Block 262, and being the Southwest
corner of this description;
Thence leaving said South line, North 330 44' 56" West a distance
of 25.00 feet to a 1/2 inch iron rod lying in the North line of said 25
foot wide alley and being the Northwest corner of this description;
Thence along the North line of said 25 foot wide alley, North
560 01' 33" East, a distance of 577.34 feet to a 1/2 inch iron rod
lying in said West right -of -way line of Grace Street, being the
Northeast corner of this description;
Thence along said West line of Grace Street, South 330 49' 35"
East 25.00 feet to the Place of Beginning and containing 14,434 square
feet (0.3291 acres), more or less.
Tract II
A tract of land being a 10 foot wide utility easement originally
dedicated in Block 262, Thompson Subdivision, an addition to the City
of Wichita Falls, Texas, pursuant to that plat of record in Volume 4,
Page 30, Wichita County Plat Records, said easement being more
specifically described by metes and bounds as follows:
Commencing at 1/2 inch iron rod lying in the intersection of the
West right -of -way line of Grace Street, a previously dedicated street,
and the South right -of -way line of Tenth Street, a previously dedicated
street, said 1/2 inch iron rod also being the Northeast corner of said
Block 262;
Thence along the South right -of -way line of Tenth Street, South
560 02' 50" West 398.63 feet to a point being the Northeast corner and
Place of Beginning of this description;
Thence South 340 12' 04" East 162.11 feet to a point for the
Southeast corner of this description;
Thence South 560 01' 33" West 10.00 feet to a point for the
Southwest corner of this description;
Thence North 340 12' 04" West 162.11 feet to a point lying in the
South right -of -way line of Tenth Street, said point being the Northwest
corner of this description;
Thence along the South right -of -way line of Tenth Street, North
560 02' 50" East 10.00 feet to the Place of Beginning and containing
0.0372 acres, more or less.
The above described alley and easement are to be closed, vacated,
and abandoned upon the filing of the final plat of Lot 1 -B, Block 262,
Thompson Subdivision in the Wichita County Plat Records.
SECTION 2. That in consideration of the receipt of Seven Thousand
Nine Hundred Seventy -Three and No /100 ($7,973.00) Dollars, the Mayor is
hereby authorized to execute a quit claim deed to Bethania Regional
Health Care Center for the above described property.
SECTION 3. It is hereby officially found and determined that the
meeting at which this ordinance was passed was open to the public as
required by law.

Mayor, for and in consideration of the sum of Seven Thousand Nine
Hundred Seventy Three and No /100 ($7,973.00) Dollars and other good and
valuable consideration, in hand paid by Bethania Regional Health Care
Center, 1517 Tenth Street, Wichita Falls, Texas 76301, hereinafter
called Grantee, the receipt of which is herein acknowledged, has
granted, sold, conveyed, released and forever quit claims unto the said
Grantee, all its right, title, and interest in and to the following
described real property situated in Wichita County, Texas, to wit:
