AN ORDINANCE REZONING 2200 AND 2202 FILLMORE, LOTS 1 & 2,
BLOCK 2A, HIGHLAND ADDITION, WICHITA FALLS, TEXAS, FROM
SINGLE FAMILY -2 TO MULTIFAMILY RESIDENTIAL CONDITIONED
(CASE R 95 -19); FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the Planning & Zoning Commission recommended that 2200 and 2202 Fillmore, Lots
1 & 2, Block 2A, Highland Addition, Wichita Falls, Texas, be rezoned from Single Family Residential
[SF -2] to Multifamily Residential Conditioned [MFR(C)] (Case R 95 -19); and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed rezoning
of the area hereafter described is in accordance with the Comprehensive Land Use Plan and in the public
interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Lots 1 & 2, Block 2A, Highland Addition, Wichita Falls, Texas, also known as 2200
and 2202 Fillmore, and shown as the shaded area on the attached map, incorporated in this ordinance as
Attachment No. 1, be rezoned from Single Family Residential [SF -2] to Multifamily Residential
Conditioned [MFR(C)] and regulated as follows:
MFR(C) MULTIFAMILY RESIDENTIAL CONDITIONED DISTRICT (R 95 -19)
PURPOSE
The purpose of the MFR(C) Multifamily Family Residential Conditioned district is to accommodate
multifamily residential development of no greater density than a quadruplex unit.
PERMITTED USES
A. The following uses are permitted in the MFR(C) district:
Residential uses
- Dwelling, Duplex or Two Family
- Dwelling, Single Family Detached
B. The following uses are permitted in the MFR(C) district subject to the Site Plan Review
provisions of Section 7100:
Residential uses
- Dwelling, quadruplex or four family, such building shall be constructed as shown on the
attached map, incorporated in this ordinance and titled "Exhibit A."
Civic Uses
- Utility Service
Commercial uses
- Oil Drilling, Subject to provisions of Chapter 21 of the Wichita Falls Code of Ordinances as
amended.
DEVELOPMENT REGULATIONS
Each site in an MFR(C) District shall be subject to the following site regulations:
1. Lot area: 5,000 sq. ft., minimum
2. Lot width: 50 ft., minimum
3. Front Setback: 25 ft. minimum, except for rear access subdivision where reduced setback as per
Section 4240 shall apply.
4. Side setback, interior.: 5 ft., minimum
5. Side setback exterior.: 25 ft. minimum except 15 ft. minimum for single - family and duplex
dwellings.
6. Rear setback:
A. Single family and duplex dwelling:
Five (5) ft. minimum from common lot line or one (1)ft. minimum from alley.
(See Section 6500 for Accessory Structure setbacks and Section 6210H for setback
requirements for rear vehicular access.)
B. All other uses: 5 ft. minimum. However, in no case shall the roof overhang extend
over the property line.
7. Height: 40 ft., maximum, except for multifamily dwellings exceeding 25 units per acre.
8. Building Coverage: 50% of lot area, maximum.
NOTE: Buffering requirements shall be reduced to 18 feet, as approved by Board of Adjustment in Case
V 95 -07, May 12, 1995.
SECTION 2. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
