AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING CHAPTER 29, "TRAFFIC" OF THE
WICHITA FALLS CODE OF ORDINANCES SO AS TO PROVIDE FOR
NEW SECTION 29 -126, PREVIOUSLY RESERVED, PROVIDING FOR
THE APPOINTMENT OF INDIVIDUALS TO ENFORCE DISABLED
PARKING LAWS; REPEALING ALL ORDINANCES AND PROVISIONS
IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND
SAVING CLAUSE; AND FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS DISCUSSED WAS OPEN
TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council of the City of Wichita Falls finds
that there is a need to insure that parking requirements for
disabled persons are met within the City of Wichita Falls; and,
WHEREAS, the City Council finds further that any and all -
parking spaces that have been designated for disabled persons
should only be used by persons who qualify as being disabled;
and,
WHEREAS, the City Council finds further that appointment of
persons to enforce disabled parking laws would be of benefit to
the citizens of the City of Wichita Falls.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:

such section to read as
"Sec. 29 -126. Appointment of individuals to enforce
disabled persons parking laws.
In accordance with Vernon's Texas Civil Statutes 6675a -5e.1,
which was adopted by the Texas Legislature of the State of Texas,
there is hereby established a disabled parking enforcement
program for the City of Wichita Falls which will allow persons to
be appointed to enforce the mandates of Article 6675a -5e.1,
Vernon's Texas Civil Statutes. There is hereby established a
disabled parking enforcement training program to be developed and
administered by the City of Wichita Falls Police Department. All
training and certification shall be done at the sole discretion
of the Chief of Police or their designee, and all decisions made

as to appointment, removal, training and implementation of the
training program and /or enforcement of disabled parking laws
shall be at the Chief of Police or their designee's discretion.
All persons appointed under this ordinance must be United States
citizens of good moral character who have not been convicted of a
felony. Upon appointment, a person must take and subscribe to an
oath of office to be administered by the City Clerk or their
designee, and must complete the approved training program as
developed by the Wichita Falls Police Department. All persons
appointed under this ordinance shall be limited to enforcement of
the mandates of Article 6675a -5e.1, Vernon's Texas Civil
Statutes, and may not enforce or have any authority to enforce
any other laws or ordinances. All persons appointed under this
ordinance shall act on a volunteer basis, and shall not be
entitled to any compensation for performing these type of duties
for the City of Wichita Falls."
SECTION 2. Should any section, paragraph, sentence, clause,
phrase or word of this ordinance be declared unconstitutional or
invalid for any purpose, the remainder of this ordinance shall
not be affected thereby.
SECTION 3. It is officially found and determined that the
meeting at which this ordinance was passed was open to the public
as required by law.
