AN ORDINANCE WAIVING SECTION 6130 OF THE ZONING ORDINANCE;
PLACING CONDITIONS UPON THE GRANTING OF THE WAIVER;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the Planning and Zoning Commission has reviewed a request from Burger King at
4004 Kemp Boulevard, acting through Sun Ports International, Inc., to place a shelter over play ground
equipment and the outdoor dining area; and
WHEREAS, the Planning and Zoning Commission has concluded that such a structure will not be
incompatible with surrounding uses if such a structure is kept neat and in good repair; and
WHEREAS, the placing of such a structure would increase the degree of nonconformity as
prohibited under Section 6130 of the Zoning Ordinance, and to allow the placing of such a structure
requires a waiver of the Section 6130 of the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Section 6130 of the Zoning Ordinance is hereby waived for Burger King at 4004
Kemp Boulevard to allow the placement of an awning structure intended to shade a play ground and
outside dining area.
SECTION 2. Burger King be required to keep the structure in good repair so as to replace any worn,
damaged, faded or otherwise deteriorated element of the structure.
SECTION 3. Such a waiver of Section 6130 of the Zoning Ordinance applies only to the Burger
King's continued use at 4004 Kemp Boulevard and is not transferable to other uses or ownership.
SECTION 4. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
