Ord 033-96 3/5/1996ORDINANCE NO. �� AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION OF THE ALLEY IN BLOCK 3, HILLCREST ADDITION; AUTHORIZING THE CONVEYANCE OF THE PROPERTY TO THE FEE OWNERS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City of Wichita Falls has received a request to close, vacate, and abandon a portion of the alley in Block 3, Hillcrest Addition; and WHEREAS, the City has determined that it is in the public interest to close the hereinafter described tracts. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Tract I FIELD NOTES OF THE ALLEY TO BE CLOSED WITH A UTILITY EASEMENT RETAINED IN BLOCK 3, HILLCREST ADDITION; BEGINNING at a 1/2" iron reinforcing rod set for the Southwest corner of Lot 13, Block 3, Hillcrest Addition, Wichita Falls, Wichita County, Texas. THENCE North 890 42' 00" E 220.64 feet along the North line of a 15' alley to a bridge spike set at the intersection of the West line of the Old Jacksboro Highway and the South line of Lot 9, Block 3 of said Hillcrest Addition; said spike bears South 480 56' 02" E 1,959.86 feet to center of circle for curve THENCE Southwesterly 19.90 feet with the West line of the Old Jacksboro Highway along a curve concave to the Southeast having a central angle of 000 34' 54" and a radius of 1,959.86 feet to a 1/2" iron reinforcing rod set on the North line of Lot 26, Block 3 of said Hillcrest Addition THENCE South 890 42' 00" W 57.57 feet along the South line of a 15' alley to a + mark made in concrete for the Northwest corner of Lot 25, Block 3 of said Hillcrest Addition THENCE North 000 18, 00" W 7.50 feet to a drill hole made in concrete THENCE South 890 42' 00" W 150.00 feet along the center line of a 15, alley to a 1/2" iron reinforcing rod set THENCE North 000 18' 00" W 7.50 feet to the place of beginning and containing 0.05 acres of land more or less. Findley and wife, Janet Findley for Tract I, and in consideration of the receipt of Fifty -Six and 25/100 ($56.25) Dollars, the Mayor is hereby authorized to execute a quit claim deed to B. D. Miller and wife, Jody Miller, for Tract II of the above described property. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
