AN ORDINANCE REZONING LOTS 20,21 & 22, BLOCK 118, HILLCREST
ADDITION, 2807 AVENUE U, AND A 60 FT. BY 150 FT. PORTION OF
AVENUE U ABUTTING LOT 22, FROM LIMITED COMMERCIAL TO
GENERAL COMMERCIAL CONDITIONED ZONING (CASE R 96 -02);
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the Planning & Zoning Commission recommended that Lots 20, 21 & 22, Block 118,
Hillcrest Addition, 2807 Avenue U, and a 60 ft. by 150 ft. portion of Avenue U abutting Lot 22, Wichita
Falls, Texas, be rezoned from Limited Commercial to General Commercial Conditioned Zoning District
(Case R 96 -02); and,
WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed rezoning
of the area hereafter described is in accordance with the Comprehensive Land Use Plan and in the public
interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Lots 20, 21 & 22, Block 118, Hillcrest Addition, also known as 2807 Avenue U, and a
60 ft. by 150 ft. portion of Avenue U abutting Lot 22, Wichita Falls, Texas, and shown as the shaded area
on the attached map, incorporated in this ordinance as Attachment No. 1, be rezoned from Limited
Commercial to General Commercial Conditioned Zoning District, and regulated as follows:
GC(c) General Commercial Conditioned Zoning District R 96 -02;
Purpose
The purpose of the GC(c) Conditioned General Commercial District is to accommodate commercial
activities on a property located on the edge of a General Commercial District. This district is established
in order to provide reasonable commercial use of a property while allowing review of land use changes
through the Conditional Use process.
Permitted Uses
A. The following uses are permitted in the GC(c) district:
Residential Uses
Dwelling, Duplex Two Family
Dwelling, Single Family Detached
B. The following uses are permitted in the GC(c) district subject to the Site Plan Review provisions
of Section 7100.
Other Permitted Uses:
Pool and Spa Sales and Service
Outdoor Display Associated With Pool and Spa Sales.
All uses listed in the Limited Commercial District regulations Section 3390 of the Zoning
Ordinance.
CONDITIONAL USES
The following uses are permitted in the GC(c) R 96 -02 District subject to the approval process provided
in Section 7200:
All of the uses in the General Commercial District Section 3470 (B) and 3480 of the
Zoning Ordinance.
DEVELOPMENT REGULATIONS
Each site in the GC(c) district shall be subject to the following development regulations except for
townhouse & zero lot -line residential use:
1. Lot area: 5,000 sq. ft., minimum
2. Lot width: 50 ft., minimum
3. Front setback: 25 ft. minimum, except for rear access subdivision where reduced setback
as per Zoning Ordinance Section 4240 shall apply.
4. Side setback, Interior:
A. Single - family and duplex dwellings: 5 ft., minimum.
B. All other uses: No minimum.
5. Side setback, exterior: 25 ft. minimum, except 15 ft. minimum for single - family and
duplex dwellings.
6. Rear setback:
A. Single family and duplex dwelling:
Five (5) ft. minimum from common lot line or one (1) ft. minimum from
alley.
(See Section 6500 for Accessory Structure setbacks and Section 6210H for
setback requirements for rear vehicular access.)
B. All other uses: No minimum. However, in no case shall the roof overhang
extend over the property line.
7. Height: No maximum.
8. Building coverage: No maximum, except 50% of lot area maximum, for single - family and
duplex dwellings.
9. Open Space: 20% of lot area, minimum, for multifamily dwellings containing 25 units or
more.
Note: See Section 4600 of the Zoning Ordinance for buffering requirements.
SECTION 2. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
