AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION OF
WASHINGTON STREET ADJACENT TO BLOCK 35, ORIGINAL TOWNSITE;
AUTHORIZING THE CONVEYANCE OF THE PROPERTY TO THE FEE OWNER;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the City of Wichita Falls has received a request to
close, vacate, and abandon a portion of Washington Street, adjacent to
Block 35, Original Townsite, and
WHEREAS, the City has determined that it is in the public interest
to close the hereinafter described tract.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1.
FIELD NOTES OF THE PORTION OF WASHINGTON STREET ADJACENT
TO BLOCK 35, ORIGINAL TOWNSITE, MORE SPECIFICALLY DESCRIBED
BY METES AND BOUNDS AS FOLLOWS:
BEGINNING in the most Southwestern corner of Lot 8, Block 35, Original
Townsite, Wichita Falls, Texas, also being a point in the North right -
of -way line of Washington Street;
THENCE Northeasterly along the North right -of -way line of Washington
Street 150 feet to a point in the most Southeastern corner of said Lot
8, Block 35;
THENCE Southeasterly along an extension of the West right -of -way line
of a 25 foot alley in Block 35, 80 feet to a point in the South right -
of -way line of Washington Street;
THENCE Southwesterly along the South right -of -way line of Washington
Street, 150 feet to a point;
THENCE Northwesterly along an extension of the West line of Lot 8,
Block 35, 80 feet to the most Southwestern corner of said Lot 8, Block
35, and the PLACE OF BEGINNING
is hereby closed vacated and abandoned, with the City of Wichita Falls
retaining a utility easement.
SECTION 2. That in consideration of the receipt of Two Hundred
Forty and no /100 ($240.00) Dollars, the Mayor is hereby authorized to
execute a quit claim deed to Hatcher Poultry and Egg Company for the
above described property.
SECTION 3. It is hereby officially found and determined that the
meeting at which this ordinance was passed was open to the public as
required by law.

THAT the City of Wichita Falls, Texas, a municipal corporation,
hereinafter called Grantor, acting by and through its duly authorized
Mayor, for and in consideration of the sum of Two Hundred Forty and
no /100 ($240.00) Dollars and other good and valuable consideration, in
hand paid by Hatcher Poultry and Egg Company, 610 Washington Street,
Wichita Falls, Texas 76304, hereinafter called Grantee, the receipt of
which is herein acknowledged, has granted, sold, conveyed, released and
forever quit claims unto the said Grantee, all its right, title, and
interest in and to the following described real property situated in
Wichita County, Texas to wit:

THENCE Northeasterly along the North right -of -way line of Washington
Street 150 feet to a point in the most Southeastern corner of said Lot
8, Block 35;
THENCE Southeasterly along an extension of the West right -of -way line
of a 25 foot alley in Block 35, 80 feet to a point in the South right -
of -way line of Washington Street;
THENCE Southwesterly along the South right -of -way line of Washington
Street, 150 feet to a point;

Grantor retains a utility easement for the purpose of laying and
maintaining all kind and character of utility lines, including water,
gas, electric, telephone, television cable, and power lines.
TO HAVE AND TO HOLD the above described premises, together with
all and singular the appurtenances thereto, in any way belonging unto
the said Grantee, its successors, and assigns.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a municipal
corporation of Wichita County, Texas, has caused this instrument to be
