AN ORDINANCE WAIVING THE 25 FOOT FRONT SETBACK
REQUIREMENT AS REQUIRED UNDER APPENDIX C, ZONING
ORDINANCE, OF THE CODE OF ORDINANCES; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council has reviewed Attachment A included herein and has concluded that
the applicant was negligent in the placement of the structure within the front setback at #7 Shelly Circle,
and that the encroachment into the setback was unintentional; and
WHEREAS, the City Council has concluded that requiring the applicant to come into compliance
with Appendix C of the Code of Ordinances would create undo financial hardship where the results of
violating this City ordinance has minimal adverse impact upon the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. That applicable sections of the Zoning Ordinance addressing the front setback
requirement are amended to allow #7 Shelly Circle to encroach into the front setback as shown in
Attachment A.
SECTION 2. That the waiver for encroachment into the front setback as shown by Attachment A
applies only to this property, and those conditions shown under Attachment A and to no other
encroachment by this structure, or any part of this structure, or any accessory structure proposed for #7
Shelly Circle.
SECTION 3. That the structure shown in Attachment A is hereby considered nonconforming, and
therefore subject to provisions under Section 6100 of the Zoning Ordinance, as amended
SECTION 4. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
