AN ORDINANCE REZONING 903 NORTH BROOK, LOT 13, BLOCK 33,
ORIGINAL TOWNSITE, FROM SINGLE FAMILY -2 TO HEAVY
COMMERCIAL CONDITIONED ZONING DISTRICT (CASE R 96 -04);
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the Planning & Zoning Commission recommended that 903 North Brook, Lot 13,
Block 33, Original Townsite, Wichita Falls, Texas, be rezoned from Single Family -2 to Heavy
Commercial Conditioned Zoning District (Case R 96 -04); and,
WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed rezoning
of the area hereafter described is in accordance with the Comprehensive Land Use Plan and in the public
interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. 903 North Brook, Lot 13, Block 33, Original Townsite, Wichita Falls, Texas, and
shown as the shaded area on the attached map, incorporated in this ordinance as Attachment No. 1, be
rezoned from Single Family -2 to Heavy Commercial Conditioned Zoning District, and regulated as
follows:
HC(c) Heavy Commercial Conditioned Zoning District R 96 -04;
Purpose
The purpose of the HC(c) Heavy Commercial Conditioned Zoning District is to accommodate an auto
repair garage and associated storage on a property located on the edge of a Single Family District.
Permitted Uses
A. The following uses are permitted in the HC(c) district:
Residential Uses
Dwelling, Duplex Two Family
Dwelling, Single Family Detached
B. The following uses are permitted in the HC(c) district subject to the Site Plan Review provisions
of Section 7100.
Non - Residential Permitted Uses:
Auto repair and associated storage of vehicles to be repaired or awaiting customer pick -up.
SPECIAL CONDITIONS
The following conditions apply to this district.
Auto salvage shall not be permitted.
All auto storage areas shall provide a six -foot privacy fence along North Brook and along
the boundary of the adjacent Single Family District.
DEVELOPMENT REGULATIONS
Each site in the HC(c) district shall be subject to the following development regulations :
1. Lot area: 5,000 sq. ft., minimum
2. Lot width: 50 ft., minimum
3. Front setback: 25 ft. minimum, except for rear access subdivision where reduced setback
as per Zoning Ordinance Section 4240 shall apply.
4. Side setback, Interior:
A. Single- family and duplex dwellings: 5 ft., minimum.
B. All other uses: No minimum.
5. Side setback, exterior: 25 ft. minimum, except 15 ft. minimum for single - family and
duplex dwellings.
6. Rear setback:
A. Single family and duplex dwelling:
Five (5) ft. minimum from common lot line or one (1) ft. minimum from
alley.
(See Section 6500 for accessory structure setbacks and Section 6210H for
setback requirements for rear vehicular access.)
B. All other uses: No minimum. However, in no case shall the roof overhang
extend over the property line.
7. Height: No maximum.
8. Building coverage: No maximum, except 50% of lot area maximum, for single - family and
duplex dwellings.
Note: See Section 4600 of the Zoning Ordinance for buffering requirements.
SECTION 2. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
