Ord 075-96 6/4/1996L7 ORDINANCE NO. 5 -q ip AN ORDINANCE AMENDING THE ZONING ORDINANCE DEFINITION AND REGULATION OF CERTAIN KINDS OF GROUP HOMES AND HALFWAY HOUSES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning & Zoning Commission recommended amending the Zoning Ordinance definition and regulation of certain kinds of group homes and halfway houses; and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed amendment hereafter described is in accordance with the Comprehensive Land Use Plan and in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION i. Appendix C, Section 2030, definitions shall be amended by adding the following: GROUP HOMES A residential living arrangement defined in the Community Home For Disabled Persons Location Act, licensed by the State to provide food and shelter; personal guidance; care; supervision for not more than (6) disabled persons and two (2) supervisors. This classification includes, assisted living for the aged for no more than six (6) persons and two (2) supervisors or nursing personnel. This does not include activities defined under "Personal Care Home." PERSONAL CARE HOME A residential living arrangement that provides food, shelter and guidance for no more than six (6) persons and two (2) supervisors or nursing personnel including but not limited to: maternity homes, shelters for victims of crime, abuse, and neglect. HALFWAY HOUSE A publicly or privately operated use providing housing for juveniles or adults, regardless of the number of residents, for any of the following: (1) residence in lieu of institutional sentencing, (2) housing for parolees, (3) residence to those needing correctional institutionalization. The underlined text shall be added to the definition of Community Residential Center. COMMUNITY RESIDENTIAL CENTER A publicly or privately operated use providing housing and care for individuals legally confined. Such use is historicallv described to include. but not limited to. orisons, iails. boot camas, and similar uses. SECTION 2. Appendix C, Section III, shall be amended by adding the following : a. The term "Group Homes" shall be added to the "Permitted Uses" section of the Single Family -1, Single Family -2, Limited Commercial, General Commercial, Multifamily Residential, Residential Mixed Use and River Development District zoning districts. "Group Homes" shall be added to the "Conditional Uses" section of the Central Business district. r M b. The term "Personal Care Home" shall be added to the "Permitted Uses" section of the General Commercial, and Central Business District zoning districts. "Personal Care Home" shall be added to the "Conditional Uses" section of the Single Family -1, Single Family -2, Limited Commercial, Multifamily Residential, Residential Mixed Use and River Development District zoning districts. C. The term "Halfway House" shall be added to the "Permitted Uses" section of the Heavy Commercial zoning district. "Halfway House" shall be added to the "Conditional Uses" section of the General Commercial, Central Business District and Heavy Commercial zoning districts. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the 4th day of June 1996.
