AN ORDINANCE MODIFYING THE FRONT SETBACK REQUIREMENT
FOR LOTS IA -9A, BLOCK 3A, OF THE PARK PLACE SUBDIVISION;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED
BY LAW.
WHEREAS, the Planning and Zoning Commission is an appointed commission by the City Council
charged with reviewing and deciding development proposals; and
WHEREAS, the Planning and Zoning Commission is unable to approve a development proposal
otherwise prohibited by law, but is required to make recommendations based on their extensive
involvement with development issues; and
WHEREAS, the Planning and Zoning Commission has heard testimony from a developer of
property described as Lots IA-9A, Block 3A of the Park Place Subdivision, where the developer is
requesting a waiver of the required front setback due to the design nature of the proposed housing units;
and
WHEREAS, the Planning and Zoning Commission has determined that such housing would be a
measurable asset to this area because of unique design considerations, and is recommending a reduced
setback along a dead end street; and
WHEREAS, the City Council concurs with the recommendation of the Planning and Zoning
Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION I. Sections of the Code of Ordinances addressing front setbacks are modified to ten feet
for properties described as Lots lA -9A, Block 3A of the Park Place Subdivision.
SECTION 2. Such waiver of the 25 foot setback is contingent upon the property owner replatting
these lots to reflect this reduced setback, and that the plat contains wording advising of this Council
action.
SECTION 3. This waiver and/or modification of the front setback requirement shall be effective for
as long as the developer or subsequent developers of these properties maintains the intent for which this
modified front setback is allowed.
SECTION 4. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
