Ord 129-96 9/3/1996ORDINANCE NO.� AN ORDINANCE REZONING APPROXIMATELY 55 ACRES OUT OF BLOCKS 26 AND 27, DENTON CO. SCHOOL LAND LEAGUE 1, WICHITA FALLS, TEXAS FROM SINGLE FAMILY -2 RESIDENTIAL TO GENERAL COMMERCIAL CONDITIONED ZONING; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning & Zoning Commission recommended that approximately 55 acres out of Blocks 26 and 27, Denton Co. School Land League 1, Wichita Falls, Texas, be rezoned from Single Family -2 Residential To General Commercial Conditioned Zoning District (Case R 96 -08); and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed rezoning of the area hereafter described is in accordance with the Comprehensive Land Use Plan and in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Approximately 55 acres out of Blocks 26 and 27, Denton Co. School Land League 1, Wichita Falls, Texas, and shown as the shaded area on the attached map, incorporated in this ordinance as Attachment A, be rezoned from Single Family -2 Residential To Conditioned General Commercial Zoning District and shall be regulated as follows: Permitted Uses A The following uses are permitted in the GC(C) district: Residential Uses - Dwelling, Duplex Two Family - Dwelling, Single Family Detached - Group Home - Personal Care Home B. The following uses are permitted in the GC(c) district subject to the Site Plan Review provisions of Section 7100. Residential Uses: - Bed & Breakfast Homestay - Boarding House - Condominium Residential - Dwelling, Multifamily - Dwelling, Zero Lot -Line Single Family, Subject to the provisions of Section 5200 - Fraternity & Sorority House - Townhouse, Subject to the provisions of Section 5300 Civic Uses: - Cemetery - College & University - Convalescent Services - Day Care Centers, Limited & Commercial - Library, Public Parks Public Safety Services Religious Assembly School, Primary and Secondary Utility Service Commercial Uses: - Alcoholic Beverage Sales, Subject to the provisions of Section 5400 - Art Gallery/Museum - Bed & Breakfast Inn - Business & Trade Schools - Clinic - Club - Convenience Store - Exterminating Services, Without chemical storage - Funeral Home - Hospital - Hotel - Indoor Sports & Recreation - Medical Office - Motel - Movie Theater - Offices - Oil Drilling, Subject to the provisions of Chapter 21 of the Code of Ordinances - Parking Facility - Radio & TV Transmitting Tower - Restaurants - Retail Trade - Services - Shopping Center - Veterinary Services Conditional Uses The following uses are permitted in the GC district subject to the approval process provided in Section 7200: - Alcoholic Beverage Sales, subject to the provisions of Section 5400 - Community Residential Center - Flea Market - Light Manufacturing - Manufactured Homes, Subject to the provisions of Section 5600 - Outdoor Entertainment and Recreation - Outdoor Storage - Warehousing Facility - Halfway House SECTION 2.
