I `J AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, ORDERING THAT A SPECIAL ELECTION BE HELD IN THE CITY OF WICHITA FALLS ON JANUARY 18, 1997, TO SUBMIT PROPOSITIONS ON THE QUESTION OF THE ADOPTION OF AN ADDITIONAL ONE -HALF OF ONE PERCENT SALES AND USE TAX UNDER THE PROVISIONS OF SECTION 321.101(b) OF THE TEXAS TAX CODE TO BE USED TO REDUCE THE CITY PROPERTY TAX RATE AND THE ADOPTION OF A SALES AND USE TAX FOR THE PROMOTION AND DEVELOPMENT OF NEW AND EXPANDED BUSINESS ENTERPRISES AT A RATE OF ONE - FOURTH OF ONE PERCENT UNDER THE PROVISIONS OF SECTION 4A OF THE DEVELOPMENT CORPORATION ACT OF 1979; ADDITIONALLY, SUBMITTING TO THE VOTERS THE PROPOSITION OF THE QUESTION OF THE ADOPTION OF AN ADDITIONAL ONE - FOURTH OF ONE PERCENT SALES AND USE TAX UNDER THE PROVISIONS OF SECTION 4B OF THE DEVELOPMENT CORPORATION ACT OF 1979; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the City Council of the City of Wichita Falls hereby directs that a special election be held in the City of Wichita Falls for the purpose of submitting propositions on the levy and collection of an additional one -half of one percent sales and use tax within the City under the provisions of Section 321.101(b) of the Texas Tax Code to be used to reduce the property tax rate in the city, and the collection of an additional one -fourth of one percent sales and use tax under the provisions of Sections 4A and 4B of Article 5190.6, V.A.C.S. (the "Act "); and, WHEREAS, the City of Wichita Falls is authorized by law to hold such an election on January 18, 1997, and is an eligible city under the provisions of Section 4A and 4B of the Act, and Section 321.101(b) of the Texas Tax Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That all of the above preambles and recitals are found to be true and correct and are incorporated herein for all purposes. SECTION 2. That an election shall be held on January 18, 1997, in the City of Wichita Falls, which date is not less than forty -five (45) days from the date of the adoption hereof, and is a uniform election date pursuant to the Section 41.01 of the Texas Election Code for the purpose of submitting the following propositions: The adoption of a sales and use tax within the City for the promotion and development of new and expanded business enterprises at a rate of one -fourth of one percent, and the adoption of an additional sales and use tax within the City at a rate of one - half of one percent, to be used to reduce the property tax rate. 2. The adoption of a Section 4B sales and use tax within the City at a rate of one- fourth of one percent to undertake projects as described in Section 4B of Article 5190.6, V.A.C.S., including but not limited to projects for a library, a police and fire training center, fire station consolidation and equipment, police and fire radio dispatch modernization, public park improvements, streets and roads, drainage, and related improvements, and the maintenance and operations expenses for any project authorized by Section 4B of Article 5190.6, V.A.C.S. SECTION 3. It is the intent of the City Council that no sales and use tax authorized pursuant to Section 4A or 4B of Article 5190.6, V.A.C.S., shall be utilized for constructing a coliseum. SECTION 4. All residential, qualified electors of the City shall be permitted to vote at such election, and shall vote FOR or AGAINST the above referenced propositions. The ballot utilized at such election shall be printed to provide for voting FOR or AGAINST the propositions. This election shall be held and conducted in accordance with the provisions of the Texas Election Code and the Texas Tax Code, Subsection (e) of Chapter 321, and the Act, and as may be required by law. All election materials and proceedings shall be printed in both English and Spanish. SECTIONS. Notice of the time and place of said election shall be given by publication in such notice in a newspaper of general circulation published in the City of Wichita Falls at least forty -five (45) days prior to the date of the January 18, 1997, election. SECTION 6. It is hereby found and determined that the meeting at which this ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the day of Q j ) , 1996.
