Ord 003-97 1/7/1997ORDINANCE NO. AN ORDINANCE REZONING A 55.0 ACRE TRACT OF LAND OUT OF B.B.B. & C.R.R. CO. SURVEY ABSTRACT 30, WICHITA COUNTY, TEXAS, 31.76 ACRES BEING ANNEXED INTO THE CITY, FROM HEAVY COMMERCIAL TO GENERAL COMMERCIAL ZONING (CASE R 96 -16); FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning & Zoning Commission recommended that a 55.0 acre tract of land out of B.B.B. & C.R.R. Co. Survey Abstract 30, Wichita County, Texas, 31.76 acres of which being annexed into the City, Wichita Falls Texas, be rezoned from Heavy Commercial to General Commercial zoning (Case R 96 -16); and, WHEREAS, the City Council of the City of Wichita Falls, Texas deems that the proposed rezoning of the area hereafter described is in accordance with the Comprehensive Land Use Plan and in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The property being a 55.0 acre tract of land out of B.B.B. & C.R.R. Co. Survey Abstract 30, Wichita County, Texas, 31.76 acres of which being annexed into the City, and shown as the shaded area on the attached map, incorporated in this ordinance as Attachment A, be rezoned from Heavy Commercial to General Commercial zoning. Said 55 acre tract being more specifically described by metes and bounds as follows: FIELD NOTES OF A 55.0 ACRE TRACT OF LAND OUT OF B.B.B. & C.R.R. CO. SURVEY ABSTRACT 30 WICHITA COUNTY TEXAS DESCRIBED AS FOLLOWS: BEGINNING at an iron rod set at the Southeast corner Lot 50, Landrum and Henderson Subdivision, Section Two, an addition to the City of Wichita Falls, Texas, according to plat recorded in Volume 27, Page 61, Wichita County Plat Records said iron rod bears N 88° 57'30" W - 99.0 feet and S 02° 18' W - 342.8 feet from the Northeast corner of B.B.B. & C.R.R. Co. Survey A -30 and being in the West right -of -way line of Arena Road; THENCE S 020 18' W with the West line of Arena Road a distance of 716.8 feet to an iron rod set in the North right -of -way line of U.S. Highway 82 -277; THENCE with the North right -of -way line of U.S. Highway 82 -277 as follows: S 30° 27' W -209.0 feet to an iron rod set; S 660 00' W - 1217.62 feet to an iron rod set from which a 4" pipe fence post bears S 43° E - 0.55 feet; S 61° 25' W - 401.5 feet to an iron rod found; S 63° 45' W - 199.84 feet to a Highway Monument found and S 66 003' W - 174.1 feet to an iron rod set for the Southwest corner of this tract; THENCE N 230 57' W at 466.0 feet pass an iron rod set and continuing N 230 57' W in all a distance 706.22 feet to a point in the center line of Call Field Canal a curve to the left for the most Westerly Northwest corner of this tract; THENCE with the center line of Call Field Canal as follows: Northeasterly with curve to the left having a radius of 287.9 feet and a central angle of 560 41' for an arc distance of 284.82 feet; N 290 53'E - 987.08 feet and N 39° 09'E - 197.24 feet to a point for the most Northerly Northwest corner of this tract; THENCE S 870 42' E, at 73.83 feet pass an iron rod set, at 977.12 feet pass the Southwest corner of said Lot 50, and continuing S 870 43' E in all a distance of 1377.12 feet to the PLACE OF BEGINNING and containing 55.0 acres of land. SECTION 2. This ordinance shall be conditional upon the adoption of a ordinance by the City Council of the City of Wichita Falls, Texas annexing the 31.76 acre portion of this 55 acre tract into the City of Wichita Falls, Texas. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
