AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS; EXTENDING THE TERM
OF ORDINANCE NO. 13 -92 WHICH GRANTED A
FRANCHISE FOR USE OF THE PUBLIC RIGHTS -OF -WAY
WITHIN THE CITY TO SOUTHWESTERN BELL
TELEPHONE COMPANY FOR THE PURPOSES OF
ENGAGING IN PROVIDING TELECOMMUNICATIONS
SERVICES WITHIN THE CITY; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the City of Wichita Falls adopted Ordinance No. 13 -92 on
February 18, 1992, granting to Southwestern Bell Telephone Company a right -of-
way franchise to provide telecommunication services within the City; and,
WHEREAS, said agreement, pursuant to Section 4, will expire April 1, 1997,
unless the City and Southwestern Bell Telephone Company agree to extend the
term of said agreement; and,
WHEREAS, the City and Southwestern Bell Telephone Company desire to
extend the terms of Ordinance No. 13 -92 for a period of two (2) years, it being to the
mutual advantage of the City and Southwestern Bell Telephone Company that
such ordinance be extended.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS:
SECTION 1. That Section 4 of Ordinance No. 13 -92, entitled "Term," is
hereby amended to read as follows:
"Term. This ordinance shall be in force and in effect from April 1, 1997,
through March 31, 1999, unless earlier terminated pursuant to Section 11; provided
that at the expiration of its initial period, such term shall be automatically
extended for successive periods of one (1) year unless written notice to terminate
this agreement is given by either party not less than sixty (60) days prior to the
termination of the then - current period. When such notice is given, this agreement
shall terminate at the expiration of the then - current period."

SECTION 2. Southwestern Bell Telephone Company shall have thirty
(30) days from and after the passage and approval of this ordinance to file its
written acceptance hereof with the City Clerk, and upon such acceptance being
filed, this ordinance shall take effect and be in force as of the first day of April,
1997.
SECTION 3. It is hereby found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
