ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 6100, NONCONFORMING
DEVELOPMENT REGULATIONS OF THE ZONING ORDINANCE; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning & Zoning Commission has reviewed Section 6100 of the Zoning
Ordinance relating to the regulation of nonconforming uses and finds that changes in these regulations are
necessary for the general welfare of the City;
WHEREAS, these changes will clarify procedures governing the expansion, alteration and
discontinuance of nonconforming uses and buildings; and
WHEREAS, the City Council concurs with the recommendations of the Planning & Zoning
Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Section 6125 shall be amended in its numbering and wording as follows:
A. Nonresidential Structures, shall be added and worded as follows
A structure which is in noncompliance with the height or setback requirements of the Zoning
Ordinance, but in compliance as to use of the structure, may be altered in a manner that does not
increase the degree of noncompliance of the height or setback requirement, as long as all other
provisions of the Zoning Ordinance including, but not limited to, building coverage, landscaping,
and parking requirements, are met. Such an addition shall be on the same lot as the original
structure, and the addition shall not be greater in area than the size of the original structure before
alteration.
B. Residential Structures, shall be added, and whereby heretofore Section 6125 contained paragraph 2,
such paragraph shall be numbered as Section 6125 (B) (1), and where heretofore Section 6125 contained
paragraph 3, such paragraph shall become Section 6125 (B) (2).
SECTION 2. Heretofore Section 6125 (B) Non - residential structures, shall be renumbered as
Section 6127 Nonconforming Uses - Expansion, and paragraph 2 amended as follows:
2. In districts other than a single - family residential district, an existing nonconforming use
may be expanded, extended or enlarged subject to the Conditional Use Permit approval
process provided in Section 7200 as long as all other provisions of the Zoning Ordinance
including, but not limited to, building coverage, landscaping and parking requirements are
met. The expansion must be on the same lot where the nonconforming use is located.
However, additional property may be used as a parking area.

SECTION 3. Section 6140 (1) is hereby amended to read as follows:
1. A nonconforming use may be converted to another nonconforming use provided the noise, odor,
• refuse, traffic volumes and patterns, hours of operation, parking requirements and other factors are
similar or less intense.
SECTION 4. Section 6145 is hereby repealed in its entirety, thereby causing Section 6150 to be
renumbered as Section 6145 and Section 6155 to be renumbered as Section 6150.
SECTION 5. It is hereby officially found and determined that the meeting at which this ordinance
was passed was open to the public as required by law.
