ORDINANCE AMENDING SECTIONS 17 -3, 17 -8 AND 17 -19 OF THE
CODE OF ORDINANCES TO PROVIDE RULES AND REGULATIONS
FOR AUTOMATED CURBSIDE COLLECTION OF REFUSE, TRASH
AND GARBAGE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1. Section 17 -3 is amended to read as follows:
"Each owner, occupant, tenant or lessee receiving manual curbside collection
shall provide suitable leakproof refuse containers for garbage and trash of not less than
(10) nor more than thirty (30) gallons capacity, constructed of substantial material and
maintained in good condition with tight- fitting lid or cover. Plastic bags designed for the
disposal of household garbage and refuse may be used. Plastic bags shall be
sufficient strength (minimum two -mil) to resist tearing under normal handling and tied
securely when placed for collection. The sanitation superintendent shall have the
authority to require substitutions when he or his representatives determine the type
containers or bags used are inadequate for intended service.
Each owner, occupant, tenant or lessee receiving automated curbside
collection shall have provided by the City a suitable refuse container. One
replacement container will be provided at no charge. Thereafter, replacement
containers will be provided but will require a $40.00 deposit. Additional
containers for additional service will be available, but will require an additional
charge as set forth in Section 17 -19."
SECTION 2. Section 17 -8 is amended to read as follows:
"Any person desiring to place tree trimmings or hedge cuttings for manual
collection shall cause the same to be securely tied for collection in bundles not heavier
than fifty (50) pounds nor more than five (5) feet in length and eighteen (18) inches in
diameter. These shall be placed with other garbage and trash for pickup at the regular
time for collection. Persons served by automated collection shall place the
trimmings completely within the container with the lid closed. If more than three
(3) bundles are removed at any (1) time, an additional fee shall be charged for the
additional hauling. The charges shall be seventy dollars (70.00) per hour for provision
of a dump truck and a crew of two (2) for hauling. A fifteen - minute travel time will be
assessed plus loading time in computing the charges."
SECTION 3. Section 17 -19 is amended by adding subsection (12) to read as
follows:
(12) Automated curbside service rates will be calculated on the same basis as
items 1 -9. Additional automated curbside service may be added to any account
for a rate (for each additional container) that is 50% of the established rate.
