Ord 009-98 2/3/1998ORDINANCE NO. 9- 9? AN ORDINANCE WAIVING SECTION 7635C OF THE ZONING ORDINANCE WHICH REQUIRES THE POSTING OF SIGNS ON EACH PROPERTY PROPOSED FOR REZONING; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Section 3020 of the Zoning Ordinance requires that each lot, parcel or site within the City carry a zoning district designation; and WHEREAS, property annexed by Ordinances 106 -97 and 107 -97 and effective on November 6, 1997 was initially zoned Single - Family 1 as required under Section 1065 of the Zoning Ordinance, until such time that permanent zoning classification is given to the area by the City Council; and WHEREAS, procedures established under Chapter 211 of the Texas Local Government Code requires that notification of a rezoning be accomplished in conformance with the manner described therein, which also provides authority for a municipality to adopt other regulations regarding the rezoning process, of which the City has adopted additional regulations under Section 7600 of the Zoning Ordinance; and WHEREAS, Section 7635C of the Zoning Ordinance requires that a sign or signs notifying of the rezoning be placed on a property proposed for rezoning throughout the period of public hearings; and WHEREAS, it is determined that the posting of such signs on all properties annexed and subject to rezoning creates unnecessary burden upon the taxpayers of the City, where an alternate procedure would accomplish the same purpose. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 7635C of the Zoning Ordinance relating to the posting of signs on properties being rezoned is hereby waived, and replaced by the requirement that such signs instead be located as shown on Attachment A and Attachment B included herein. SECTION 2. It is necessary to provide the appropriate zoning to take advantage of development opportunities necessary for the development of this area where development inquiries are common for tracts of land identified in Attachments A and B, where such opportunities may arise prior to the required 30 day waiting period following the passage of an ordinance, where inappropriate land uses or inappropriate designations of land use categories existing with the effective date of annexation in these areas could have adverse effects upon the peace, health and safety of the City by effectively denying economic development in the area for a period, this Ordinance shall become effective immediately upon passage. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
