Min 04/05/2011 214 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building April 5, 2011 Item 1 The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o'clock a.m., with the following members present. Glenn Barham - Mayor Dorothy Roberts-Burns - Mayor Pro Tern Linda Ammons - Councilors Michael Smith - Rick Hatcher - Tim Ingle - Mary Ward - Darron Leiker - City Manager Miles Risley City Attorney Lydia Ozuna - City Clerk Mayor Barham called the meeting to order. Item 2a Reverend Charles Pearce, Pastor St. Marks United Methodist Church, gave the invocation. Item 2b Mayor Barham led in the Pledge of Allegiance. Item 3a Mayor proclaimed April 2011 as "Child Abuse Prevention Month" in Wichita Falls. Patsy Baggett and several board members and other volunteers accepted the proclamation. Item 3b Mayor recognized Pat Thacker as the recipient of the 2011 Patsy Baggett Children's Service Award. Mrs. Thacker expressed appreciation for the award, however, she stated that the award belongs to all the volunteers and workers who strive to prevent child abuse. Item 3c Mayor proclaimed April 2011 as "Cancer Control Awareness Month" in Wichita Falls and encouraged everyone to support the Relay for Life event June 3-4, in its fight against this debilitating disease. Karel Davis, American Cancer Society, accepted the proclamation and invited everyone to participate in Relay for Life. 215 Item 3d Mayor proclaimed April 10-16 as "Public Safety Telecommunicators Week" in Wichita Falls and urged citizens to express their appreciation to these telecommunicators. Jane Ward and Deputy Chief Manuel Borrego accepted the proclamation. Item 3e Mayor proclaimed April 4-10, as "National Public Health Week". Health Director Lou Franklin and several of her staff accepted the proclamation; she encouraged citizens to take advantage of their Health Fair and the many services being provided at that time. Item 3f Mayor recognized Mrs. Sharon Hill, Airport Operations Assistant, Aviation, Traffic&Transportation Department, as Employee of the Month for April 2011. Mayor presented Mrs. Hill with a plaque, a letter of appreciation, restaurant tickets, and a check. Item 4 Several persons had signed up to speak, noting on the sign-in sheet that they were here to request extension of time to repair hazardous structures. These persons spoke after the public hearing on hazardous structures, Item 8a. Item 5a-5b Minutes of the March 10, 2011 and March 15, 2011 Council meeting were approved as distributed. Items 6a-6c City Manager gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Roberts-Burns that the Consent Agenda be approved. Through The Houston-Galveston Area Council Of Governments, In The Amount Of$78,115.00 216 Item 6c RESOLUTION NO. 28-2011 Resolution Confirming An Appointment To The Firefighters' And Police Officers' Civil Service Commission Items 7a-7e Minutes of the following boards and commissions were received. (a) Wichita County-Wichita Falls Public Health Board, January 28, 2011 (b) Wichita Falls Economic Development Corporation, January 31, 2011 (c) Traffic Safety Commission, February 17, 2011 (d) Park Board, February 24, 2011 (e) Landmark Commission, February 11, 2011 Item 8a A Public Hearing was held to determine if certain buildings and/or structures are considered to be dangerous. Mayor declared the public hearing open. Community Development Director Norm Standifer informed that due process notices were mailed to property owners subject to this action. There is a thirty-day period in which they have authority to demolish their own structures before we proceed with demolition, if that is Council's desire. Lori Rounsaville will provide detailed information on these structures. Mrs. Rounsaville addressed the following structures. Property owners who requested extension of time are noted. Item 1. 1219 N. 2"d Street, Owner-Stephanie J.Wiley Item 2. 2705 Ridgeway Drive, Owner-Stems, Inc. Mike Sneller, 4106 Picasso, requested time to renovate this property. Mayor suggested 30 days to pull a permit and 90 days for substantial completion, for total of 120 days.. Item 3. 100 E. 2"d Street, Owner-Shirley Coleman Item 4.903 Gerald Street, Owner-Mae Edna Reece Item 5. 917 Chance Street, Owner-Evie Jean Moms Item 6. 606 Marconi Street, Owner-William A.Allen Jr., et al Item 7. 611 Marconi Street, Owner-Jackson Memorial Church Item 8. 711 Jalonick Street, Owner-Janice M. Etvir Ben Waldon Janice Waldon, 814 Jalonick, informed she is in the process of getting the property in her name so she can give to her cousin Calvin Calhoun. She requested additional time for her cousin to repair the property. Mr. Calhoun informed that he has already begun to work on the property and structure. Mayor suggested 30 days to pull a permit and ninety days for substantial completion, for a total of 120 days. Item 9. 503 Fort Worth, Owner-Yvonne Fuller Item 10.409 Fort Worth, Owner-Myrta Etvir Thomas McBride Item 11. 111 Sharon Lane, Owner- Elim Asamblea De Dios Church Ramona Enriquez, 317 Lee Street, overseer for Elim Asamblea De Dios Church, expressed desire to demolish the structure, but estimates have been out of their price range. If the City can demolish for less they would agree to have the City do it. Mayor informed that the City could demolish the structure and there would be a lien placed on the property, but he could not guarantee that it would be less expensive since we would not know until we have the bids as to the cost of demolition. Mrs. Enriquez agreed to have the City demolish the structure. Item 12. 1302 21st Street, Owner-Donald Dolan Donald Dolan, 1209 2W' Street, informed that he has begun to clean up the property; he wants to use the front structure as storage, and the other structure as a carport; he will tear down the structure with fire damage,which is a small shed. Mayor suggested 30 days to pull a permit and ninety days for substantial completion, for a total of 120 days. Item 13. 2215 8"'Street, Owner- Floyd A. Vaughn Item 14. 2306 Roberts Avenue, Owner-Terry Eugene O'Roark Item 15. 1311 Giddings Street, Owner was David Wayne Faines, now Tiffany Gonzales Tiffany Gonzales, 1205 Burnett, informed she has already begun to clean the outside and inside, will tear down structures in the back and plans to repair only the house. 217 Item 8a continued Mayor suggested 30 days to pull a permit and ninety days for substantial completion, for a total of 120 days. Item 16. 1510 Giddings Street, and Item 17, 1512 Giddings Street, Owner- Shirley Wesbrooks Estate Charles Peters, 2518 Sheppard Access, general contractor, said he has been asked by Mark Wesbrooks to see what it would take to secure the property. He plans to cleanup the properties and have them secured; then begin to fix them up. Mayor and Council strongly recommended that he take care of these two properties. 30 days to pull a permit and ninety days for substantial completion. Item 18, 2145 Avenue D, Owner- Patricia A. Chesson Item 19, 1604 Kemp Blvd., Owner- Susan Peters Item 20.a., 1600 Beverly Dr.,aka 1602 Beverly; Item 20b. 1600 Beverly Dr. aka 1601 Cherry; Item 20c. 1600 Beverly Dr. aka 1603 Cherry; and Item 20d 1600 Beverly Dr. aka 1606 Cherry, Owner of all four structures is Demetrius A. Reyes Demetrius A. Reyes, 2703 Doris, provided his project plan and timeframe to repair these structures. Councilor Smith read neighborhood concerns, which included the safety of children, as well as other health issues, safety concerns, squalor issues, among others, which have been ongoing for at least four years and possibly ten years. He was not in favor or extending time on these structures and will vote to demolish all structures. Council consensus was to demolish these structures. Mayor declared the public hearing closed. City Clerk informed that three persons had signed up to speak regarding hazardous structures that are not on this demolition list. Building Inspection Administrator Bobby Teague informed that both of these were properties that were previously considered by Council but ownership has changed and they want an opportunity to bring back to Council for extensions. Edwin Menchaca, 700 Lobban, purchased 1038 Harlan, which was on a previous demolition list; but he was instructed by Code Enforcement to purchase the property first then come to Council to request an extension. Randal Sorensen, general contractor, informed that Edwin and Oscar Menchaca work for him and he has agreed to pull the permits and work with them on both properties, 1038 Harlan and 2609 Linden. Mr. Teague informed that staff recommends bringing these two properties back to Council and give the new property owners some additional time to make repairs. Mayor directed that both of these properties, 1038 Harlan and 2609 Linden be placed on the April 19 Council agenda for consideration. Gloria Phillips, 400 Burnett, referred to 433 Tulsa stating that the structure had been demolished. Mayor instructed Mrs. Phillips to speak with Property Manager Pat Hoffman and she will report to the Council. Mayor called for additional comments on property structures. There were none. Item 8b ORDINANCE NO. 16-2011 Ordinance Finding Certain Buildings And/Or Structures To Be Dangerous; Requiring Property Owners To Demolish Said Buildings And/Or Structures Within 30 Days Of The Date Of This Ordinance; And Declaring An Emergency and Immediate Effective Date Moved by Councilor Ammons that Ordinance No. 16-2011 be passed. Motion seconded by Councilor Smith. Moved by Mayor Barham that Ordinance No. 16-2011 be amended to allow the 218 Item 8b continued following properties 30 days to obtain a permit and 90 days for substantial completion, for a total of 120 days. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Moved by Councilor Smith to amend Ordinance 16-2011 be amended by requiring that property owners pay all taxes before a building permit is issued. Motion seconded by Councilor Robert-Bums David Brock, 320 Hilltop, stated that this would negate the ability for property owners to work out a tax payment plan with the Tax Assessor Collector. If you require them to have all the money for the taxes before they can pull a permit you will negate their ability to finance repairs. If they are making payments on the taxes they can make the repairs and they would stay on the tax rolls bringing in revenue. It is in the best interest of the City for them to rehab the structures. Moved by Councilor Smith to modify his amendment to include the stipulation that taxes be paid or a payment plan be established to pay the taxes. Motion seconded by Councilor Roberts-Bums. Councilor Ingle felt we were getting into murky water making them pay taxes when we do not have the authority to make them pay taxes. Motion carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, , and Ward Nays: Councilor Ingle Main motion as amended carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None City Council recessed at 10:10 a.m. and reconvened at 10:30 a.m. Item 9a ORDINANCE NO. 17-2011 Ordinance Amending Ordinance 08-2011 To Replace Election Judges Who Are Unable To Serve In The May 14, 2011 Election Moved by Councilor Roberts-Burns that Ordinance No. 17-2011 be passed. Motion seconded by Councilor Hatcher and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None 219 Item 9b ORDINANCE NO. 18-2011 Ordinance Appropriating $217,757 To The Special Revenue Fund For The Ryan White Early Intervention Grant And Authorizing The City Manager To Execute All Documents Necessary To Accept Said Grant from Tarrant County and the Texas Department of State Health Services Moved by Councilor Ammons that Ordinance No. 18-2011 be passed. Motion seconded by Councilor Hatcher and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None Item 10a RESOLUTION NO. 29-2011 Resolution Awarding The Bid For The 2011 Street Rehabilitation Project (CWF11-100-04) To Zack Burkett Company, In An Estimated Total Amount Of$2,727,734.45 Moved by Councilor Ammons that Resolution No. 29-2011 be passed. Motion seconded by Councilor Ward and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None Item 10b RESOLUTION NO. 30-2011 Resolution Authorizing An Increase Of The Annual Lease Amount On 10 Lake Arrowhead Leases With Review Dates In 2011 From $600 To $690, With The Next Review'Dates In 2016 Moved by Councilor Roberts-Burns that Resolution No. 30-2011 be passed. Motion seconded by Councilor Ammons and carried by the following vote. Motion seconded by Councilor Ammons and carried by the following vote. Ayes: Mayor Barham, Councilors Ammons, Smith, Roberts-Burns, Hatcher, Ingle, and Ward Nays: None 221 Item 11 a Public Works Director Russell Schreiber presented a report regarding a Proposed Pilot Project to clear overgrowth near the Wichita River. Item 11 b Council members brought up the following matters. Councilor Linda Ammons: a) Expressed appreciation to the staff for responding to inquiries that Council forwards to them. Councilor Timothy Ingle: a) Expressed appreciation to Public Works Director and his staff for what they have done starting to look at storm water projects, flooding issues, and the traffic flow on Rhea Road and Callfield. b) Thanked Code Enforcement especially Lori Rounsaville for her work and professionalism; it is a difficult job. c) Commented that Assistant City Manager is happy to have Norm Standifer on the hot seat instead of him; he welcomed Norm. d) Asked City Attorney to explain what happens to property taxes that are never paid. City Attorney gave an explanation. Councilor Rick Hatcher: a) Reminded citizens that parking vehicles in front yards is illegal unless that surface is for parking or driving a car on, that includes property on the side of your home. Councilor Michael Smith: a) Update on landscaping at the intersections downtown. Mr. Murphy provided an update. b) Recycling laws and projects being talked about by legislature covering refunding for beverage container return, as well as take back of electronics and devices that- contain mercury. Many cities have begun to look at this and we need to look at it to see if we want to support it with a resolution. b) He and several councilors participated in the Mayors for Meals and participated in meals on wheels route. They need the support; keep them in our thoughts as a local project that we need to have. c) Earthquake preparedness —John Henderson prepared a good report for Council, and we now know what needs to be done. He clarified that he did not intend to change any building codes. d) Jim Dockery provided Council a survey on tax rates, and those rates place us on the mid point as far as tax and utility rates. e) Castaway Cove advertised concerts, extended hours, and new prices after 4 p.m. Councilor Mary Ward: a) Several staff took a tour of District 5 and looked at parks, streets; I just wanted people to know where we were out there. Appreciate those who participated. b) Asked if it was legal to have high school students pick up trash along the highways. City Manager commented that it would depend on whether they were City Streets or TXDOT highways; we could help coordinate with TXDOT on the highways. She wanted students, through this type of project, to feel a sense of pride in their community and the particular areas they beautify. Councilor Dorothy Roberts-Burns: a) Congratulated Pat Thacker for receiving the Patsy Baggett Children's Service Award; she is very deserving. b) Thanked Public Works Director Russell Schreiber for keeping Council aware of what is happening with the flooding ; citizens are happy to know you do have a project in the works. 222 Item 12 City Council went into Executive Session at 11:31 a.m. in accordance with Texas Government Code Section 551.071.
