AN ORDINANCE AMENDING THE ZONING ORDINANCE TO ADD
NURSERY AND LANDFILL TO CERTAIN ZONING DISTRICTS AND
PROVIDING DEFINITIONS; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission has determined that certain
land uses are not specifically listed per se in the Zoning Ordinance and has
recommended that such uses be added to the Zoning Ordinance; and
WHEREAS, the City Council has determined that adding certain land uses to the
Zoning Ordinance would serve the public purpose.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The land use Nursery is hereby added to the Permitted Use
section of the Zoning Ordinance under the General Commercial and Heavy Commercial
zoning districts and as a Conditional Use in the Residential Mixed Use zoning district
with the following definition added to Section 2010:
Nursery
Land use to raise and store flowers, trees, shrubs and plants for sale, which may also
contain a structure for maintenance of the property.
SECTION 2. The land use Landfill is hereby added to the Conditional Use
section of the Zoning Ordinance under the Heavy Commercial and Heavy Industrial
zoning districts with the following definition added to Section 2010:
Landfill
An area of land used for solid waste disposal in which refuse is buried underground
between layers of dirt or fill material.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
