Ord 045-98 5/19/1998El ORDINANCE NO. AN ORDINANCE REZONING 7.21 ACRES OUT OF KEMP'S WEST END ADDITION, BLOCKS D, H, & 1 (800 KEMP BLVD.), WICHITA FALLS, TEXAS, FROM LIMITED OFFICE TO PLANNED UNIT DEVELOPMENT ZONING; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning & Zoning Commission recommended that 7.21 acres out of Kemp's West End Addition, Blocks D, H, & 1 (800 Kemp Boulevard), Wichita Falls, Texas, be rezoned from Limited Office to Planned Unit Development zoning; and, WHEREAS, the City Council of the City of Wichita Falls, Texas, deems that the proposed rezoning of the area hereafter described is in accordance with the Comprehensive Land Use Plan and in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The property described as being 7.21 acres out of Kemp's West End Addition, Blocks D, H, & 1 (800 Kemp Boulevard), Wichita Falls, Texas, and shown as the shaded area on the attached map, incorporated in this ordinance as Attachment A, be rezoned From Limited Office to Planned Unit Development zoning district and shall be regulated as follows: Use and Development Regulations: The Bluebonnet Villas development is represented by a Master Plan for development entitled "Planned Unit Development Site Plan" which is made part of this ordinance as Attachment B. The development regulations shall be as follows: Permitted Uses a. Duplex Dwellings: A maximum of 26 duplex structures being 52 dwelling units, shall be permitted as shown on the Master Plan for the development. Development Regulations a. Parking: Two parking spaces shall be provided for each dwelling unit, or four parking spaces per duplex structure. Each parking space shall have a minimum width of eight feet. Two paved parking spaces per dwelling unit shall be provided within the front setback area. Spaces within an enclosed garage shall not be counted. b Lot Area: The minimum lot area shall be 3,000 square feet. C. Lot Width: The minimum lot width shall be 30 feet, measured at the building limit line. d. Front Setback: 25 ft. minimum. e. Side Setback Exterior: 15 ft. minimum. f. Side Setback Interior: Five feet minimum on one side. On the other side a primary structure may be constructed across a property line, with the property line dividing the structure between two lots. Accessory buildings shall have a setback of five feet minimum from a side or rear property line. g. Rear Setback: Five foot minimum. h. Access and Circulation: Access and circulation will be in accordance with the Master Plan. Building Coverage: 50% of lot area, maximum. j. Height: 35 feet maximum. k. Sign Regulations: Signs shall be regulated by the Zoning Ordinance with the same restrictions as apply in a Multifamily zoning district. Miscellaneous Signs: Construction, directional, nameplate, and real estate signs shall be allowed as per the provisions of Table 6741. M. Sidewalks: Sidewalks shall be constructed along all public streets, as required by applicable City ordinances. Master Plan for Development The Master Plan referred to in this ordinance shall be controlling regardless of who might develop the property. Other Requirements All regulations of the zoning ordinance which have not been specifically addressed in this ordinance shall apply to this Planned Unit Development Ordinance and are hereby made a part hereof and included herein. SECTION 2. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
