ORDINANCE NO.42
AN ORDINANCE REZONING 61.2 ACRES OUT OF BLOCK 9, OF THE
KEMP AND NEWBY SUBDIVISION OF THE CHEROKEE COUNTY
SCHOOL LANDS, FROM GENERAL COMMERCIAL TO HEAVY
COMMERCIAL.; FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC
AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission has determined that the
proposed rezoning of the area hereafter described is in accordance with the
Comprehensive Land Use Plan and should not adversely impact adjacent or
neighboring properties; and
WHEREAS, the City Council concurs with the recommendation and finds that
such rezoning is in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The property described as 61.2 acres out of Block 9, of the Kemp
and Newby Subdivision of the Cherokee County School Lands, Wichita Falls, Texas,
and shown on Attachment A herein included as part of this Ordinance, be rezoned from
General Commercial to Heavy Commercial. The property is more specifically described
by metes and bounds as follows:
Beginning at an iron rod which bears S 890 25' E a distance of 62.50 feet from a point in
the West line of Block 9 of the Cherokee County School Land, 1479.0 feet South of its
Northwest corner, said beginning point being the Northeast corner of a 3.92 acre tract
conveyed to Texas Electric Service Company by warranty deed recorded in Volume
581, Page 60, Wichita County Deed Records;
THENCE S 890 25' E at 490.83 feet passing an ell corner of said Block 9 and
continuing on same course with the most Easterly North line of said Block 9, in all a
total distance of 1525.0 feet;
THENCE South a distance of 420.0 feet;
THENCE S 890 25' E a distance of 295.0 feet to the Northwest corner of Lot 2, Block 9
Kemp and Newby Subdivision;
THENCE along the West line of said Lot 2, Block 9, Kemp and Newby Subdivision,
Subdivision, S 01001' W a distance of 648.54 feet to a point for corner in the centerline
of a 50 foot wide state drainage easement as recorded in Volume 858, Page 26,
Wichita County Deed Records;
THENCE along the said centerline of 50 foot wide state drainage easement, as follows:
S 410 54' E a distance of 155.93 feet to a point for an angle point;
S 000 57' W a distance of 380.17 feet to a point for the Southwest corner of said Lot 2,
Block 9 and for the Southeast corner of this tract, said point lies in the North right -of-
way line of Central Freeway (U.S. 82 and 287).
THENCE along the said North right -of -way of Central Freeway as follows:
N 88° 52' 34" W a distance of 815.0 feet to an iron rod at the point of curvature, along a
curve to the right, having a radius of 5539.08 feet, a central angle of 11 ° 20' 13 ", for an
arc distance of 1096.0 feet to an iron rod in the above said East line of 3.92 acre tract
for the Southwest corner of this tract;
THENCE leaving said North right -of -way line of Central Freeway (U.S. 82 & 287), N 001
55'35" E a distance of 1431.98 feet to the PLACE OF BEGINNING and containing 61.2
acres of land.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
