Ord 064-98 8/18/1998ORDINANCE NO. (4 ` AN ORDINANCE RELOCATING A 15 -FOOT WIDE UTILITY EASEMENT IN LOT 7D, BLOCK 5, RIVERCREST PARK ADDITION, AN ADDITION TO THE CITY OF WICHITA FALLS, TEXAS; DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Berend Brothers Inc. are the owners of Lot 7D, Block 5, Rivercrest Park Addition, as recorded in Volume 26, Page 523; Wichita County Plat Records; and, WHEREAS, the property owners desire relocate a 15 -foot wide utility easement dedicated on said plat to eliminate a partial encroachment of their building; and, WHEREAS, the City of Wichita Falls will also benefit from the relocation of said easement by the dedication of a new easement centered on the public sewer line. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The 15 -foot wide utility easement dedicated on the plat of Lot 7D, Block 5, Rivercrest Park Addition, as recorded in Volume 26, Page 523; Wichita County Plat Records, is hereby vacated and abandoned. SECTION 2. As a replacement, a 15 -foot wide easement, described in the attached instrument, incorporated in this ordinance as Attachment "A," and as shown on the attached map, Attachment "B," shall be dedicated by filing said instrument for record in the Wichita County Courthouse. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. TO HAVE AND TO HOLD, said easement perpetually to the City of Wichita Falls, a municipal corporation, its successors and assigns, together with the right and privilege at any and all times to enter said premises, or part thereof, for purposes of constructing, servicing, maintaining and operating said utility lines, appurtenances and connections; all upon the condition that the City of Wichita Falls, after doing any work in connection with the construction, maintenance, and operation of said utility lines, restore the ground as nearly as possible to the condition in which it was found before such work was undertaken.
