ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS, AMENDING
SECTION 31 -27 OF THE CODE OF ORDINANCES ENTITLED
"DEFINITIONS" TO REDEFINE THE TERM "OWNER- OPERATOR ";
PROVIDING FOR INCLUSION IN THE CODE; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1. Section 31 -27, "Definitions," of the Code of Ordinances be
amended at the term "Owner- Operator" and at Subsection (c) so that such provisions
shall read as follows:
"Owner- Operator. Is a person, meaning an individual, and does not include a
partnership, association, company, or corporation, who has a right of possession to
a single vehicle operated as a taxicab pursuant to a contractual agreement with a
franchise holder and who holds legal title to said single vehicle in accordance with any
of the following circumstances:...
(c) The legal title to said vehicle is registered to the franchise holder and
there exists a lease- purchase contract between the title holder(s) and the individual
owner - operator as purchaser, and said purchase contract has been reviewed and
approved by the city."
SECTION 2. It is the intention of the City Council of the City of Wichita Falls,
Texas, that the provisions of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may
be renumbered or relettered to accomplish such intention.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
