AN ORDINANCE CLOSING PUBLIC HEARING AND FINDING CERTAIN
BUILDINGS AND /OR STRUCTURES TO BE DANGEROUS; COMMANDING
PROPERTY OWNERS TO DEMOLISH SAID BUILDINGS AND /OR
STRUCTURES WITHIN THIRTY (30) DAYS OF THE DATE OF THIS
ORDINANCE AND DECLARING AN EMERGENCY; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Code Enforcement Supervisor and the City of Wichita Falls, acting
under the provisions of Article III of Chapter 7 of the Code of Ordinances of the City of Wichita
Falls, has served notice to the owners of the property listed in Section 3 of this ordinance, that
the building or buildings on the premises have been classified as dangerous structures and
that certain corrections were needed to be made or the building(s) demolished; and,
WHEREAS, the property owners and all other persons having an interest in the
property have been duly served by the Code Enforcement Supervisor of the time and date of
the Public Hearing for the property owners to appear before the City Council to show cause
why such buildings or structure in Section 3 should not be demolished in accordance with the
State of Particulars set forth in the Code Enforcement Supervisor's notice; and said Public
Hearing was had and held at the time and place fixed therefore, to wit, on the 2nd day of
February, 1999 at 8:30 A.M. in the Council Chambers in the City of Wichita Falls, Texas, and
at such Public Hearing the following protests and objections were made, to wit:

and said hearing was continued until all desiring to be heard were given full fair opportunity to
be heard and the City Council of the City of Wichita Falls, having fully considered all property
matters, is of the opinion that the said hearing should be closed.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. Said hearing be and the same is hereby closed, and the said protests and
objections, and any and all other protest objections, whether enumerated or not, be and the
same are hereby overruled, except as identified on Exhibit A. If corrective actions are not
completed within the period authorized by the City Council acting as Building Commission the
structure will be demolished.
SECTION 2. From the evidence presented in the aforementioned Public Hearing by
property owners appearing and the Code Enforcement Supervisor of the City of Wichita Falls,
the building and /or structures at the locations listed in the Section with the corresponding

property owners, are found to be dangerous buildings as defined in said Article III, and the
property owners listed or any other person having an interest in said buildings as shown by
title search by the City of Wichita Falls, are hereby commanded to repair or demolish the
buildings and /or structures in accordance with the State of Particulars set forth in the Code
Enforcement Supervisor's notice. The property owners listed or any other person having an
interest in said buildings as shown by title search by the City of Wichita Falls is further
commanded to repair or demolish in accordance with the State of particulars set forth in the
Code Enforcement Supervisor's notice within thirty (30) days from the date of this ordinance.

having an interest in said buildings as shown by title search by the City of Wichita Falls is
further commanded to demolish in accordance with the State of particulars set forth in the
Code Enforcement Supervisor's notice within thirty (30) days from the date of this ordinance.

SECTION 4. If, within thirty (30) days from the date of this ordinance, any such building
listed in this Section has not been demolished, as appropriate, it shall be demolished and
removed at the expense of the City by the City or its contractor, and the net cost for demolition
or removal shall be charged to the owners of the property and assessed on the land on which
the building stood.
The fact that the demolition of dangerous buildings is being delayed pending the taking
effect of this ordinance created an emergency for the immediate preservation of the public
business place, property, health, safety and general welfare of the public which requires that
this ordinance shall become effective from and after the date of its passage and is accordingly
so ordained.
SECTION 5. It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.

119 Lee Street
Sergio Morales requested additional time to rebuild the structure. Mr. Morales
was granted an additional six months, and instructed to talk with Mr. Jim King. He was
directed to complete work on the building to bring it up to minimum standards.
Item No. 6
207 Patterson Street
Loretta Carr, 1029 Ridgeway, is in the process of purchasing 207 Patterson
from Mark Nacol and requested one year to rehab the structure into a center for
disabled persons. Mrs. Carr was granted thirty days to provide proof of ownership and
transfer of title, and if this is not accomplished within those thirty days, the structure will
be demolished by the City. If this requirement is met, Mrs. Carr will be allowed a total of
sixty days, including the thirty days to provide proof of ownership, to provide proof of
financial capability, plans, obtain a building permit and show considerable progress.
Item No. 7
700 Bonner Street
Lee Ester Pope, San Angelo, Texas, requested additional time to make repairs
to the structure. Mr. Pope was granted an additional six months to provide plans, obtain
a building permit and show considerable progress.

1201 Smith Street
Mr. King informed that the owners will get with him after this public hearing.
They are requesting additional time to repair the structure. They were granted an
additional six months.
Item No. 22
1302 Thirty First Street
Michael A. McDaniel requested additional time to repair the structure. He was
directed to talk with Mr. King to discuss his plans and obtain the necessary permits. Mr.
McDaniel was allowed an additional six months.

1312, 1314, and 1316 Thirty First Street
Kevin Grimes, owner of 1312 31" Street and potential owner of 1314 and 1316
31' Street, said he would like to demolish the structure at 1316 31St Street and
requested 60 -90 days to accomplish this. Mr. Grimes was allowed to demolish 1316
31s' Street and was instructed to provide ownership documents of 1314 and 1312 31st
Street to Mr. King., The City will demolish 1312 and 1314 31s' Street. Mr. Grimes
concurred.
Item No. 28
1516 Kell West
Rick Neas, 3107 Avenue S, son of Lillie E. Neas, requested additional time to
rehab the structure. He was granted an additional six months and was directed to take
out a building permit and provide plans to Mr. Jim King.

Mr. Jim King informed that the owners had requested that the structure be
demolished.

Mrs. Economou requested additional time to rehab the structure. She was
allowed an additional six months to make repairs and was directed to talk with Mr. King.

1702 Fairfax
John Levatte, #10 McNabb, requested additional time to make repairs. He was
granted an additional six months, and within thirty days of those six months he is to
secure the buildings. Mr. King will review the issue of zoning and will review that matter
with Mr. Levatte.
