ORDINANCE AMENDING CHAPTER 15Y2, FLOOD DAMAGE
PREVENTION, TO REQUIRE A FINISHED FLOOR ELEVATION OF ONE
FOOT ABOVE THE BASE FLOOD ELEVATION; DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council has found that repetitive losses to properties from
the effects of building within floodplains causes increases in property insurance and
increased taxpayer burden from mitigation efforts to reduce such damage which does
not serve public purpose; and,
WHEREAS, the City Council is considering reasonable methods to reduce flood
damage and repetitive losses from flooding; and,
WHEREAS, the City Council has determined that requiring a higher finished floor
elevation for properties within the floodplain best serves the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 15Y2 -60 (1) is amended in its entirety as follows:
Residential construction. New construction and substantial improvement of any
residential structure shall have the lowest floor (including basement) elevated
one foot or more above the base flood elevation. A registered professional
engineer, architect or land surveyor shall submit a certification to the floodplain
administrator that the standard of this subsection, as proposed in section 15Y2 -45
is satisfied.
SECTION 2. Section 15'/2 -60 (2) is amended in its entirety as follows:
Nonresidential construction. New construction and substantial improvements of
any commercial, industrial or other nonresidential structure shall either have the
lowest floor (including basement) elevated one foot or more above the base
flood elevation or, together with attendant utility and sanitary facilities, be
designed so that below the base flood elevation the structure is watertight with
walls substantially impermeable to the passage of water and with structural
components having the capability of resisting hydrostatic and hydrodynamic
or
loads and effects of buoyancy. A registered professional engineer or architect
shall develop and /or review structural design, specifications, and plans for the
construction, and shall certify that the design and methods of construction are in
accordance with accepted standards of practice as outlined in this subsection. A
record of such certification, which includes the specific elevation (in relation to
mean sea level) to which such structures are flood proofed, shall be maintained
by the floodplain administrator.
SECTION 3. Section 15%2 -60 (4) (b) is amended in its entirety as follows:
Require that manufactured homes that are placed or substantially improved
within Zones Al -30, AH and AE on the community's FIRM on sites (i) outside of
a manufactured home park or subdivision, (ii) in a new manufactured home park
or subdivision, (iii) in an expansion to an existing manufactured home park or
subdivision, or (iv) in an existing manufactured home park or subdivision on
which a manufactured home has incurred "substantial damage" as a result of a
flood, be elevated on a permanent foundation such that the lowest floor of the
manufactured home is elevated one foot or above the base flood elevation and
be securely anchored to an adequately anchored foundation system to resist
flotation, collapse and lateral movement.
SECTION 4. Section 15Y2 -60 (4) (c) 1. is amended in its entirety as follows:
The lowest floor of the manufactured home is one foot or above the base flood
elevation; or
SECTION 5. Section 15Y2 -62 (1) is amended in its entirety as follows:
All new construction and substantial improvements of residential structures have
the lowest floor (including basement) elevated above the highest adjacent grade
at least one foot above the depth number specified in feet on the community's
FIRM (at least two (2) feet if no depth number is specified).
SECTION 6. Section 15Y2 -62 (2) (a) is amended in its entirety as follows:
Have the lowest floor (including basement) elevated above the highest adjacent
grade at least one foot above the depth number specified in feet on the
community's FIRM (at least two (2) feet if no depth number is specified); or
SECTION 7. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
