Ord 025-99 4/6/1999ORDINANCE NO.� ORDINANCE AMENDING CHAPTER 31 OF THE CODE OF ORDINANCES, VEHICLES FOR HIRE, SECTION 31 -27, DEFINITIONS, AND SECTION 31- 51(B), PASSENGER LIMITATIONS; DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, it is the policy of the City of Wichita Falls to provide for and to promote adequate and efficient taxicab service in the city; and WHEREAS, it is the intent of the City Council that under no circumstances shall any vehicle licensed as a taxicab carry more than eight occupants, driver included. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Chapter 31 of the Code of Ordinances, Vehicles For Hire, Section 31 -27, Definitions, is hereby amended as follows. Taxicab. A chauffeured motor vehicle, used to transport persons for hire that typically operates on irregular routes, irregular schedules, and a call - and- demand basis, but does not include ambulances, buses, limousines or special service vehicles as regulated by other city ordinances. The vehicle shall have a manufacturer's rated passenger capacity of eight or less, or, in the event that the manufacturer's rating is greater than eight, then sufficient seats must have been permanently removed from the vehicle to reduce the number of seats available to accommodate not more than eight (8) occupants. SECTION 2. Chapter 31 of the Code of Ordinances, Vehicles For Hire, Section 31 -51, Passenger limitations, is hereby amended as follows. (b) A driver may not carry at the same time more people than the designed seating capacity of the taxicab, and in no event shall the number of occupants including the driver exceed eight. (c) It shall be a prima facie violation of this ordinance should any vehicle licensed as a taxi be found to have installed seats sufficient to carry more than eight occupants regardless of whether more than eight occupants are observed in the vehicle. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
