Ord 035-99 5/4/1999i i ORDINANCE NO. 35 -99 ORDINANCE CANVASSING THE RETURNS OF THE MUNICIPAL 'ENERAUSPECIAL ELECTION HELD IN THE CITY OF WICHITA FALLS, TEXAS ON MAY 1, 1999, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW WHEREAS, the City Council of the City of Wichita Falls has heretofore called for a general /special election to be held in said City on May 1, 1999 to elect a Councilor at Large, Councilor District 1, Councilor District 2 and to vote on the proposition hereinafter stated; and WHEREAS, the election officers who held said election have duly made the returns of the result thereof, and said returns have been duly delivered to said City Council, and WHEREAS, it is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by the Texas Government Code, Section 551.002, and WHEREAS, after canvassing the returns of said election, it was found to be duly and legally held in all respects, and that 4,844 voters voted in said election, and that votes were cast as follows: FOR COUNCILOR AT LARGE: Donald "Donn" Ruth Arthur Bea Williams Arnold W. Oliver FOR COUNCILOR, DISTRICT 1: Dan A. Shine received 94 votes. received 3,067 votes. received 1.629 votes. received 773 votes. COUNCILOR DISTRICT 2: James Esther, Jr. received 505 votes. Rich Kline received 52 votes. PROPOSITION: Shall the City be authorized to sell at fair market value, surplus park property in East Lynwood Park, said property being described as a 0.52, more or less, acre tract of land located in the southwest corner of Block Twenty (20) Lynwood Addition, an addition to the City of Wichita Falls, Wichita County, Texas: Yes M received 3.481 votes received 613 votes NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Said election was in all respects legally held in accordance with the laws of the State of Texas and the Charter and the Ordinances of the City of Wichita Falls. SECTION 2. The City Council officially finds, determines and declares the results of said election to be that Arthur Beatrice Williams was duly and legally elected Councilor At Large; Dan A. Shine was duly and legally elected Councilor District 1, and James Esther, Jr. was duly and legally elected Councilor District 2, and that Proposition regarding sale of surplus park property in East Lynwood Park has received a favorable majority vote in all respects and has carried. SECTION 3. It is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public as required by law. PASSED AND APPROVED this 4th day of May, 1999.
