Ord 054-99 7/6/1999ORDINANCE NO. 514 G ORDINANCE REZONING 11.4 ACRES OUT OF BLOCK 5, KEMP'S SUBDIVISION, FROM SINGLE FAMILY RESIDENTIAL TO GENERAL COMMERCIAL CONDITIONED ZONING AND AMENDING THE COMPREHENSIVE PLAN; DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC; AS REQUIRED BY LAW. WHEREAS, the Planning and Zoning Commission recommended rezoning 11.4 acres out of Block 5, Kemp's Subdivision; and, WHEREAS, the Planning and Zoning Commission acknowledged that conditions in the proposed area have changed and recommended amending the Land Use Plan, and element of the Comprehensive Plan; and, WHEREAS, the City Council of the City of Wichita Falls, Texas, deems that the proposed rezoning of the area hereafter described will be in accordance with the Comprehensive Land Use Plan. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City of Wichita Falls Land Use Plan, an element of the Comprehensive Plan for the City of Wichita Falls, Texas is hereby amended for 11.4 acres out of Block 5, Kemp's Subdivision, shown on the attached map, incorporated in this ordinance as Attachment "A ". Said property land use designation shall be changed from Low Density Residential to Commercial. SECTION 2. The property described as 11.4 acres out of Block 5, Kemp's Subdivision, Wichita Falls, Texas, and shown on the attached map, incorporated in this ordinance as Attachment "A ", shall be rezoned from Single Family -1 to General Commercial Conditioned zoning. The regulations for this Conditioned General Commercial District are incorporated into this ordinance as Attachment "B ". SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the 6th day of July, 1999. These areas would be located along major streets and encouraged to use site designs, which have mutual benefits with other businesses in the area. Permitted Uses A. The following uses are permitted in the GC(c) district: Residential Uses Dwelling, Duplex Two Family Dwelling, Single Family Detached Group Home B. The following uses are permitted in the GC(c) district subject to the Site Plan Review provisions of Section 7100. Residential Uses: - Personal Care Home - Bed & Breakfast Homestay - Boarding House - Condominium Residential - Dwelling, Multi - Family - Dwelling, Zero Lot -Line Single Family, subject to the provisions of Section 5200 - Fraternity and Sorority House - Townhouse, subject to the provisions of Section 5300 rivir I ICAO' - Cemetery - College and University - Convalescent Service - Day Care Center, Limited and Commercial - Library, Public - Public Safety services - Religious Assembly - School Primary and Secondary - School, Primary and Secondary - Utility Service Commerical Uses: - Art Gallery and Museum - Bed and Breakfast Inn - Clinic - Funeral Home - Hospital - Hotel - Medical Office - Movie Theater - Nursery - Office - Parking Facility - Storage Buildings - Services - Veterinary Services Conditional Uses The following uses are permitted in the GC(c) district subject to the approval process provided in Section 7200: - Alcoholic Beverage Sales, subject to the provisions of Section 5400 - Automotive Sales and Service - Boat Sales and Service - Bus Station - Business and Trade School - Community Residential Center - Contractors Yard - Convenience Store - Exterminating Service without chemical storage - Flea Market - Halfway House - Indoor Sports and Recreation - Kennel - Light Manufacturing - Manufactured Homes - Motel - Outdoor Entertainment and Recreation - Outdoor Storage - Radio and TV Transmitting Tower - Retail Trade - Residential Care Facility - Restaurant - Self Storage /Mini Warehouse - Shopping Center Warehousing Facility Development Regulations Each site in the GC(c) district shall be subject to the same developmental regulations as apply in the General Commercial Zoning District.
