ORDINANCE NO. t- -q9
AN ORDINANCE CLOSING AND ABANDONING A 15 X 100 FOOT
UTILITY EASEMENT IN LOT 19 -C, BLOCK 16, HILLCREST ADDITION,
AN ADDITION TO THE CITY OF WICHITA FALLS, TEXAS;
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, James and David Gilmore are the owners of Lot 19 -C, Block 16,
Hillcrest Addition, Wichita Falls, Texas, as recorded in Volume 27, Page 408, Wichita
County Plat Records; and,
WHEREAS, City of Wichita Falls Ordinance 2 -96 closed the 15 foot wide alley
lying within this property and retained a 15 x 100 foot utility easement; and,
WHEREAS, the City executed a quit claim deed conveying the alley property to
the David Gilmore for the sum of Six Hundred Fifty Four and No /100 ($654.00) Dollars,
and;
WHEREAS, said property owners request to close, vacate, and abandon the
utility easement retained on the above referenced property; and,
WHEREAS, the City of Wichita has determined that it is in the public interest to
close, vacate and abandon the said easement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That in consideration of the receipt of Two Hundred Seventy Six
and No /100 ($276.00) Dollars, the 15 foot wide by 100 foot long utility easement
retained in Ordinance 2 -96, and further described in the attached field notes,
incorporated in this ordinance as Attachment "A ", is hereby closed, vacated and
abandoned.
SECTION 2. The City Clerk is hereby directed to file a certified copy of this
ordinance with the County Clerk of Wichita County, Texas.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.

BEGINNING at the intersection of the South line of an existing utility easement with the
West line of Lot 19 -C, Block 16, Hillcrest Addition which bears N 000 00'20" E -125.0 feet
from its Southwest corner;
THENCE N 890 59'45" E with the South line of said easement a distance of 100.0 feet to
the end of the easement;
THENCE N 000 00' 20" E a distance of 15.0 feet to a point in the North line of said
easement;
THENCE S 890 59'45" W with the North line of said easement a distance of 100.0 feet to
the West line of said Lot 19 -C;
THENCE S 000 00'20" W with the West line of said Lot 19 -C a distance of 15.0 feet to the
