ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, ADDING SECTION 12 -7 TO CHAPTER 12 OF THE
CODE OF ORDINANCES, ASSESSING A COURT COST OF FIVE
DOLLARS ON EACH PARKING VIOLATION FOR FUNDING
ASSISTANCE OF SCHOOL CROSSING GUARD PROGRAM; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, Article 102.014 of the CODE OF CRIMINAL PROCEDURE, entitled "Court
costs for child safety fund in municipalities," allows municipalities that have an
ordinance regulating parking violations to assess a court cost on each parking violation
not to exceed $5.00; and,
WHEREAS, this $5.00 fee must be used for a school crossing guard program if
the municipality operates one; and,
WHEREAS, the City operates such a program in conjunction with the Wichita
Falls Independent School District, and funding has recently been provided through the
City's General Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Chapter 12 of the Code of Ordinances is hereby amended by the
addition of Section 12 -7, to read as follows:
"Sec. 12 -7. Court costs for child safety fund.
In addition to collection of all fees and court costs authorized by state law, and
as ordained in Section 12 -2 of the Code of Ordinances of the City of Wichita Falls, the
Municipal Court shall assess and collect a five- dollar child safety fund fee from each
person convicted of a parking violation in the Municipal Court of Record of Wichita
Falls. All fees collected under this section shall be paid to the director of finance to be
held on deposit by said person in a fund to be known as the Municipal Court Child
Safety Fund. All funds held may be dispensed, as needed, by the director of finance to
fund the City's share of the school crossing guard program, operated in conjunction
with the Wichita Falls Independent School District."
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
