ORDINANCE MAKING AN APPROPRIATION IN THE GENERAL FUND
IN THE AMOUNT OF $17,848 TO MAKE A REFUND TO BELL
PROCESSING AS DIRECTED BY THE WICHITA COUNTY APPRAISAL
DISTRICT FOR TAXES PAID FOR THE 1998 TAX YEAR;
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Section 25.25(d) of the Texas Property Tax Code provides that at
any time prior to the date that taxes become delinquent, a property owner may file a
motion with the appraisal review board to change the appraisal roll to correct an error
that resulted in an incorrect appraised value for the owner's property; and
WHEREAS, the owner of Bell Processing filed such a motion for taxes paid for
the 1998 tax year; and
WHEREAS, after reviewing financial information presented by the owner of the
property, the Wichita County Appraisal Review Board determined that the property was
over appraised in the amount of $3,934,432; and
WHEREAS, the taxing entities of Wichita County have been directed by the
Wichita County Appraisal District to refund taxes that were over -paid on the property
due to the correction in the appraised value of the property; and
WHEREAS, because the taxes were collected for the 1998 tax year it is
necessary to appropriate funds to make such a refund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. An appropriation in the amount of $17,848 is hereby approved in
the General Fund to make a tax refund to the owner of Bell Processing in the amount of
$17,847.31 for taxes paid that were determined by the Wichita County Appraisal
Review Board to have been made in error.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
