RESOLUTION NO. 112-2013
Resolution Authorizing The Purchase Of Microfiltration Membrane
Elements From Siemens Industry Incorporated, In The Amount Of
$109,000.00
WHEREAS, the microfiltration (MF) membrane elements at the Cypress Water
Treatment Plant are in need or replacement in order to improve the efficiency of the
operation; and
WHEREAS, the City Council finds that this purchase is exempt from the state
requirements for competitive bidding pursuant to Tex. Local Gov’t Code § 252.022(a)(2)
because it is a procurement necessary to preserve or protect the public health and
safety of the residents of the City of Wichita Falls by improving the quality of potable
water; and
WHEREAS the City Council finds that this purchase is exempt from the state
requirements for competitive bidding pursuant to Texas Local Government § 252.022
(a)(7)(A), which exempts from competitive bidding purchases of “items that are available
from only one source because of patents, copyrights, secret processes, or natural
monopolies;” and,
WHEREAS, the City Council finds that purchasing MF membrane elements to
order to complete the settlement agreement between the City, MW Builders, and
Siemens Industry Incorporated is in the best interest of the citizens of the City of Wichita
Falls.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
City Staff is authorized to execute all documents necessary to purchase MF
membrane elements from Siemens Industry Incorporated, in the amount of
$109,000.00.
