ORDINANCE REZONING 2206 BROOK FROM LIMITED COMMERCIAL
TO CONDITIONED GENERAL COMMERCIAL ZONING; DETERMINING
THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission recommended rezoning 2206
Brook Avenue from Limited Commercial to Conditioned General Commercial Zoning;
and,
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems that the
proposed rezoning of the area hereafter described is in accordance with the
Comprehensive Land Use Plan and in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The property known as 2206 Brook Avenue, also being described
as a 175 x 470 foot, 0.94 acre, triangular tract out of Abstract 281, Wichita Falls, Texas,
and shown as the shaded area on the attached map, incorporated in this ordinance as
Attachment "A ", be rezoned from Limited Commercial to Conditioned General
Commercial. The regulations for this Conditioned General Commercial District are
incorporated into this ordinance as Attachment "B ".
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.

CONDITIONED GENERAL COMMERCIAL ZONING DISTRICT GC(C)
Purpose
The purpose of this GC(C) Conditioned General Commercial Zoning District is to
accommodate limited commercial activities with the requirement for a conditional use
permit for more intensive uses. Conditions shall be placed on development where
appropriate to reduce adverse, off -site impacts.
Permitted Uses
A. The following uses are permitted in the GC(C) district:
Residential Uses:
Dwelling, Duplex Two Family
Dwelling, Single Family Detached
Group Home
Civic Uses:
Day Care Centers, Limited
Private Recreational Areas, Limited
B. The following uses are permitted in the GC(C) district subject to the Site Plan
Review provisions of Section 7100 and to the provisions of Section 3420 Special
Conditions.
Residential Uses:
- Bed & Breakfast Homestay
- Boarding House
- Condominium Residential
- Dwelling, Multifamily, Up to 25 units per acre
- Dwelling, Zero Lot Line Single Family, Subject to Section 5200
- Fraternity & Sorority Houses
- Townhouse, Subject to the provisions of Sec. 5300
Civic Uses:
- Day Care Centers, Commercial,
- Library, Public
- Parks
- Public Safety Services
- Religious Assembly
- School, Primary & Secondary
- Utility Service
1,200 s.q. ft. or less GFA.
Commercial Uses:
- Bed & Breakfast Inn
- Medical Offices, 1,200 sq.ft. or less in gross floor area.
- Offices, 1,200 sq.ft. or less in gross floor area.
- Oil Drilling, Subject to the provisions of Chapter 21 of the Wichita Falls
Code of Ordinances as amended.
- Services 1,200 sq.ft. or less in gross floor area, excluding automotive
repair services and restaurants
Conditional Uses
The following uses are permitted in the GC(C) district subject to the approval process
provided in Section 7200 and to the provisions of Section 3420 Special Conditions.
Residential Uses:
Dwelling, Multifamily, Exceeding 25 units per acre
Manufactured Homes, Subject to the provisions of Sec. 5600
Personal Care Home
Civic Uses
Day Care Centers, Commercial, more than 1,200 sq. ft. in gross floor area
- Residential Care Facility
Commercial Uses:
- Art Gallery/Museum
- Car Wash
- Clinic
- Club
- Convenience Stores
- Medical Offices, more than 1,200 sq.ft. in gross floor area
- Offices, more than 1,200 sq.ft. in gross floor area
- Restaurant Limited
- Retail Trade, Excluding automobile sales and supermarkets.
- Services, more than 1,200 sq.ft. in gross floor area, excluding automotive
repair services and restaurants.
Development Regulations
Each site in a GC(C) District shall be subject to the following development regulations,
except for zero lot line residential and townhouses.
I. Lot area: 5,000 sq. ft., minimum
2. Lot width: 50 ft., minimum
3. Front Setback: 25 ft. minimum, except for rear access subdivision where reduced
setback as per Section 4240 shall apply.
4. Side setback, int.: 5 ft. minimum
5. Side setback, ext.: 25 ft. minimum except 15 ft. minimum for single family and
duplex dwellings.
6. Rear setback:
A. Single family and duplex dwelling:
Five (5) ft. minimum from common lot line or one (1) ft. minimum from
alley. (See Section 6500 for Accessory Structure setbacks and Section
6210H for setback requirements for rear vehicular access.)
B All other uses: 5 ft., minimum. However, in no case shall the roof
overhang extend over the property line.
7. Height: 35 ft. maximum
8. Building coverage: 55% of lot area, maximum, except 50% of the lot area,
maximum, for single - family and duplex dwellings.
9. Open Space: 20% of lot area, minimum, for multifamily dwellings use containing
25 units or more.
Note: See Section 4600 for buffering requirements.
Special Conditions
A. Outdoor storage or display of any kind shall be prohibited.
B. Regulation of signs shall be the same as in a Limited Commercial Zone.
