Ord 099-99 9/21/1999ORDINANCE NO. G� - CAq AN ORDINANCE AMENDING CHAPTER 20, ARTICLE III, "ABANDONED, INOPERATIVE, OR JUNKED MOTOR VEHICLES," AT SECTION 20 -41, "DEFINITIONS," TO CHANGE THE DEFINITION OF JUNKED VEHICLES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, there is a need for the regulation of abandoned, inoperable, or junked motor vehicles on private or public property because they have an adverse effect as to the surrounding land values and the community as a whole; and, WHEREAS, abandoned, inoperable, or junked motor vehicles located in areas have been shown to cause reduction in property values of residential properties, and may adversely affect the overall economic welfare of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Chapter 20 of the Wichita Falls Code of Ordinances, at Article III, "Abandoned, Inoperative or Junked Motor Vehicles," is hereby amended to read as follows: "ARTICLE III. ABANDONED, INOPERABLE OR JUNKED MOTOR VEHICLES Sec. 20 -41. Definitions. For the purposes of this article, the following words shall have the meanings hereinafter given: (a) Junked vehicle means a vehicle that is self - propelled and: (1) does not have lawfully attached to it: (A) an unexpired license plate; or (B) a valid motor vehicle inspection certificate; (2) is wrecked, dismantled or partially dismantled, or discarded; or (3) is inoperable and has remained inoperable for more than: (A) 72 consecutive hours, if the vehicle is on public property; or (B) 30 consecutive days, if the vehicle is on private property. (b) Person: Any individual, firm partnership, association, corporation, company or p organization of any kind. (c) Demolisher. Any person whose business is to convert a motor vehicle into processed scrap or scrap metal, or otherwise to wreck or dismantle motor vehicles. (d) Storage facility: A garage, parking lot, or any type of facility or establishment for the servicing, repairing, storing or parking of motor vehicles. (e) Antique auto: Passenger cars or trucks that were manufactured in 1925 or before, or which become thirty -five (35) or more years old. (f) Special interest vehicle: A motor vehicle of any age which has not been altered or modified from original manufacturer's specifications and, because of its historic interest, in being preserved by hobbyists. (g) Collector: The owner of one or more antique or special interest vehicles who collects, purchases, acquires, trades or disposes of special interest or antique vehicles or parts of them for his own use in order to restore, preserve and maintain an antique or special interest vehicle for historic interest." SECTION 2. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. Should any section, paragraph, sentence, clause, phrase or word of this ordinance be declared unconstitutional or invalid for any purpose, the remainder of this ordinance shall not be affected thereby. SECTION 4. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
