AN ORDINANCE AMENDING CHAPTER 26, ENTITLED "PUBLIC
LIBRARY," AT SECTION 26 -2, ENTITLED "APPOINTMENT," TO
PROVIDE FOR A TERM OF OFFICE FOR MEMBERS OF THE LIBRARY
ADVISORY BOARD; AND AT SECTION 26 -3, ENTITLED
"ORGANIZATION," TO REMOVE THE PROVISION ESTABLISHING A
COUNCIL MEMBER AS AN EX OFFICIO MEMBER OF SUCH BOARD;
PROVIDING FOR INCLUSION IN THE CODE; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1. Chapter 26, "Public Library," at Section 26 -2, "Appointment," be
amended so that such section shall read as follows:
"Sec. 26 -2. Appointment.
The members of the library advisory board shall be appointed by the city council
and shall hold office for a term of three (3) years; however, the initial terms shall be
staggered so that three (3) of the nine (9) members shall be initially appointed for terms
ending June 30, 1984; three (3) of the members shall be initially appointed for terms
ending June 30, 1985; and three (3) of the members shall be initially appointed for
terms ending June 30, 1986. Thereafter, all members' terms shall end on July 31. All
vacancies shall be filled by appointment by the city council and shall be for the
remainder of the term of the vacating member. No member shall be allowed to hold
office for more than two (2) consecutive full terms. A member of the library advisory
board shall be automatically removed if the member is absent without cause for three
(3) consecutive regularly scheduled meetings. In addition, any member of the library
advisory board may be removed at any time by a five- sevenths majority vote of the city
council, and no reason need be given for such removal."
SECTION 2. Chapter 26, "Public Library," at Section 26 -3, "Organization," be
amended so that such section shall read as follows:
"Sec. 26 -3. Organization.
The city council shall select from the library advisory board a chairman. The
library advisory board shall adopt such rules and regulations for the orderly conduct of
its affairs as it may see fit, consistent with the provisions of this chapter and the charter
and other ordinances of the city. The library administrator shall act as secretary of the
board, without additional compensation. The secretary shall keep a record of all
transactions of the board, and shall provide the board with all information necessary for
the performance of its duties."
SECTION 3. It is the intention of the City Council of the City of Wichita Falls,
Texas, that the provisions of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may
be renumbered or relettered to accomplish such intention.
SECTION 4. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
