Ord 119-99 11/16/1999ORDINANCE NO. 1�1 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE RELEASE OF RESTRICTIONS CONTAINED IN THE 1986 DEED TO THE WICHITA COUNTY HERITAGE SOCIETY FOR THE LITTLEST SKYSCRAPER COMPLEX; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, on May 30, 1986, the City of Wichita Falls conveyed to the Wichita County Heritage Society certain property known as the Littlest Skyscraper Complex; and, WHEREAS, such conveyance to the Wichita County Heritage Society contained restrictions regarding the use or operation of said property; and, WHEREAS, the Wichita County Heritage Society desires to convey the Littlest Skyscraper Complex to a third party; and, WHEREAS, it is necessary for the City Council to release the restrictions contained in its 1986 deed to the Wichita County Heritage Society to facilitate the sale; and, WHEREAS, it is the desire of the City Council that the sale of this property by the Wichita Heritage Society will facilitate the long term preservation and utilization of the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to execute the necessary legal documents to release the deed restrictions and limitations contained in the Deed to the Wichita County Heritage Society dated May 30, 1986, and filed in Volume 1434, Page 224 of the Official Records of Wichita County. Before executing any release authorized by this Ordinance, the City Manager shall first determine that the proposed documents of sale of the property by the Wichita County Heritage Society shall contain adequate provisions to insure the long term preservation and utilization of the improvements on the property. SECTION 2. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
