Min 09/03/2013 CITY COUNCIL MINUTES PAGE 1 OF 5 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building September 3, 2013 Item 1 - Call To Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Glenn Barham - Mayor Michael Smith - Councilors Ben Hoover Annetta Dotson - Brian Hooker - Tim Ingle - Mary Ward - Darron Leiker - City Manager Miles Risley - City Attorney Tracy Norr - City Clerk - - - - - - - - Mayor Barham called the meeting to order. - - - - - - - - Item 2a - Invocation Councilor Smith gave the invocation. - - - - - - - - Item 2b - Pledge of Allegiance Mayor Barham led in the Pledge of Allegiance. - - - - - - - - Item 3a – Proclamation – Blood Cancer Awareness Month Mayor Barham proclaimed the month of September 2013 as Blood Cancer Awareness Month. Jordan Mathis accepted the proclamation and said she was diagnosed with blood cancer when she was 18 years old. She is currently in remission. - - - - - - - - CITY COUNCIL MINUTES PAGE 2 OF 5 Item 3b- Proclamation – National Preparedness Month Mayor Barham proclaimed September 2013 as National Preparedness Month. Emergency Management Coordinator John Henderson accepted the proclamation. Mr. Henderson urged those present to prepare for emergencies, stay informed, and get involved. - - - - - - - - Item 3c – Proclamation – Museum Day Mayor Barham read the proclamation setting September 14, 2013 as Museum Day. Cynthia Laney accepted the proclamation and urged participation in the Stroll ‘n Roll Day. - - - - - - - - Item 3d – Employee of the Month – Randal Reel, Fire Department Mayor Barham recognized Captain Randal Reel, Fire Department, as Employee of the Month for September 2013. He presented a plaque, a letter of appreciation, restaurant tickets, and a check to Mr. Reel and thanked him for his service. - - - - - - - - Item 4 - Comments From The Public To Members Of The City Council Concerning Items That Are Not On the City Council Agenda. There were no comments from the public. - - - - - - - - Item 5 - Approval Of Minutes Of The August 20, 2013 Regular Meeting Of The Mayor And City Council Minutes of the August 20, 2013 City Council Meeting were approved as distributed. - - - - - - - - Item 7 – Public Hearing on Proposed Property Tax Rate for the 2013-14 Fiscal Year A public hearing was opened at 8:46 a.m. to accept comments on the proposed property tax rate for the 2013-2014 fiscal year. There were no comments given. The public hearing was closed at 8:50 a.m. - - - - - - - - Items 6 and 8 - Consent Agenda City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Hooker that the Consent Agenda be approved. Motion seconded by Councilor Ingle and carried by the by the following vote. CITY COUNCIL MINUTES PAGE 3 OF 5 Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None - - - - - - - - Item 8 – Council Bill #142 RESOLUTION NO. 94-2013 Resolution Clarifying Councilor Representation Of Third Parties To Prohibit Some Conflicts And Waive Other Future, Potential Conflicts - - - - - - - - Item 6 – Receive Minutes Minutes of the following boards and commissions were received. a) Wichita Falls Parks Board, June 27, 2013 b) Lake Wichita Study Committee, July 9, 2013 - - - - - - - - Item 9a – Council Bill #143 ORDINANCE NO. 47-2013 Ordinance Amending The Code Of Ordinances Of The City Of Wichita Falls To Add Section 102-41 To Authorize Police Officers To Impound Motor Vehicles For Lack Of Insurance Or Valid Driver’s License And To Modify Section 26-767 To Increase Allowable Non-Consent Towing Fees; Repealing Conflicting Ordinances; And Providing For Codification Moved by Councilor Ingle that Ordinance No. 47-2013 be passed. Motion seconded by Councilor Dotson and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None - - - - - - - - Item 9b – Council Bill #144 ORDINANCE NO. 48-2013 Ordinance Making An Appropriation To The Special Revenue Fund For Grant Revenue From The Texas Department Of Transportation (TxDOT) For A Comprehensive Selective Traffic Enforcement Program (STEP) Grant For Fiscal Year 2014 And Authorizing The City Manager To Execute All Documents Necessary To Accept Said Funds CITY COUNCIL MINUTES PAGE 4 OF 5 Moved by Councilor Hoover that Ordinance No.48-2013 be passed. Motion seconded by Councilor Dotson and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None - - - - - - - - Item 12 - Executive Session City Council went into Executive Session at 9:09 a.m. in accordance with Texas Government Code §551.071, §551.072, and §551.087. City Council reconvened at 9:19 a.m. The Mayor announced that no polls or votes were taken during Executive Session. - - - - - - - - Item 12 – Appointment Of Member To Helen Farabee MHMR Board Of Directors Moved by Councilor Smith that Sara Rugeley be reappointed to the Helen Farabee Regional MHMR Center Board of Directors with term to expire August 31, 2015. Motion seconded by Councilor Hooker and carried by the following vote: Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None - - - - - - - - Item 10a - Council Bill #145 RESOLUTION NO. 95-2013 Resolution Authorizing The City Manager To Execute An Interlocal Agreement Between City Of Wichita Falls And Wichita County For Use Of 500 Travis Street As County Parking Lot And MPEC Overflow Parking Moved by Councilor Hoover that Resolution No. 95-2013 be passed. Motion seconded by Councilor Ingle and carried by the following vote. Ayes: Mayor Barham, Councilors Smith, Hoover, Dotson, Hooker, Ingle, and Ward Nays: None - - - - - - - - CITY COUNCIL MINUTES PAGE 5 OF 5 Item 11a – Staff Council Discussion City Manager Darren Leiker said the Health Department would present an update on the Health Coalition. - - - - - - - - Item 11c –Update From The Health Department On The Health Coalition Amy Fagan, Assistant Director of Health, gave an update on the Wichita Falls Health Coalition. She reviewed the background of the coalition and the goals. She noted the coalition is a field-story for the national association because of its success in getting members to participate. - - - - - - - - Item 11b – Discussion Of Items Of Concern To Members Of The City Council Members of the City Council presented the following matters: Councilor Dotson asked about the policy for pickup of large items. Russell Schreiber explained the service that is offered. Councilor Dotson also said there were some flooded properties that she would talk to Mr. Schreiber about. Councilor Ingle commented about the new sound system. Councilor Smith thanked the staff for the August activities. He expressed concern about the pay situation for the employees and challenged the rest of the council to look at options to help the situation. Mayor Barham said the pay situation needs to be addressed this year or next year and there will probably need to be a tax increase next year. He noted construction on the airport building will start next week. He listed September activities, including the Fiesta parade, Stroll N Roll, and football.
